Albanian defenders ask for his release ‘violated democratic principles’
The lawyers of the Albanian arrested last November 26th in San Marino they presented a request for immediate release, or, alternatively, to grant bail. I’m Marco Bosco of the Rimini Forum and Antonio Masiello of the San Marino Forum. In a note sI write that Nikolin Livadi, the 31-year-old born in Albania but residing in Rimini, was arrested on his birthday. “He is accused – they write – of being part of a group of subjects dedicated to the thefts in apartments that took place in recent months in San Marino. However, there is no evidence or indications of guilt. The above took place in complete completion of any treaty and/or convention disregarding all the principles of a civil and democratic society”. “It is his right to know the accusations brought against him as well as the evidence against him”, they continue, hypothesizing a claim for damages for unjust detention. In fact “It does not appear that the same was the recipient of either a complaint or identification as the perpetrator of the alleged crimes. He does not appear to have been arrested in flagrante delicto. It does not appear that he has ever crossed the border of San Marino or been stopped for any violation of the law previously”.
In the long note they claim that the 31-year-old was passing through the Titano, awaited by 15 friends from Coriano in a restaurant in Rimini to dine and celebrate. They continue by recalling how the man has a clean record in Italy and an asylum seeker in the European Union and speak of “sensational oversight” by the authorities. They respond point to point to the clues of guilt related to the presence of the car several times in the area, to the tires dirty with mud, to the names on his cell phone of other Albanians suspected of theft.
Attorney Bosco concludes by saying that “the precautionary measure of prison is disproportionate and not supported by the existence of serious indications of guilt” and requires the set freealso on bail, “indicating the amount to be paid in the form of a surety”.
