a lawyer absent for health reasons; “sled” witness hearing
In some respects, the developments of today’s hearing, of the procedure that sees, are unexpected Buriano accuser of simple defamationfor an intervention in a session of 5 years ago of Plenary Judicial Council. According to the investigators, the figure and work of the then Executive Magistrate was denigrated Valeria Pierfelici. The defendant subsequently appealed against a penal conviction; hence the indictment. But once the process had begun, both the Defense and the Tax Prosecutors had underlined that there were no conditions from practicabilityin the case of a punishable offense a lawsuit biased; while it was one complaint-explained the one presented by Pierfelici. And this net of the observations on the merits regarding any causes of justification or reciprocity of offenses.
Expected to last just 15 minutes for today’s hearing; both sides probably envisioned one quick closure of the process. The Judge Saldarelli instead, he requested an interlocution on preliminary questions, also with a view to a possible one retraining of the facts. The reference is to the article which punishes theoffense to the honor of persons vested with public powers; but that hypothesis of crime – Buriani’s lawyers had previously remarked – had already been investigated and archived. In short, the Defense has not hidden its own surpriseand requested a term for further information.
On the table the possible hearing, as witnesses, of the Magistrate Gilberto Happy; for some time at the ECHR. The PFfor his part, he specified that he had no preliminary requests.
Will resume the February 15th another process, far more complex. The one who always sees Buriani on trial, in this case together with the former Secretary of State Simone Celli; to which were added – after the reunification – Carlo Filippini and Antonio Fabbri, of the newspaper The information. A series of testimonies were expected today; also of the President of CBSM Tomasetti. Inevitable however the postponementseen theabsence – for reasons of greeting – of the Defender of some defendants.
