GenevaFederal court overturns Pierre Maudet’s acquittal for Abu Dhabi trip
The complaint of the Geneva public prosecutor’s office has been heard. In relation to the financing of a survey, however, the Federal Supreme Court has acquitted the ex-State Councilor of Geneva.
That’s what it’s about
-
The Federal Supreme Court has approved an appeal by the Geneva public prosecutor’s office in the Maudet case.
-
The acquittal that was issued by the cantonal court in December 2021 has thus been overturned.
-
Pierre Maudet is traveling to the Formula 1 Grand Prix in Abu Dhabi in 2015 – the trip was paid for by the country’s authorities.
At the end of November 2015, Pierre Maudet took part in a trip to the Formula 1 Grand Prix in the Emirate of Abu Dhabi as State Councilor for the Canton of Geneva. He was accompanied at the time by his family, his chief of staff Patrick Baud-Lavigne and Antoine Darum.
The costs of the trip were fully covered by the authorities in Abu Dhabi. In February 2021, the Geneva Canton Police Court convicted Pierre Maudet and Patrick Baud-Lavigne of accepting an advantage, Magid Khoury of granting an advantage and Antoine Therefore of being an accessory to the granting of an advantage. In December 2021, the Criminal Chamber of the Cantonal Court of the Canton of Geneva spoke of those affected allegations free. The Geneva public prosecutor’s office, on the other hand, lodged a complaint with the Federal Supreme Court, which has now passed a verdict.
“The decision of the cantonal court was wrong”
The Federal Supreme Court partially approved the appeal, overturned the contested decision and referred the matter back to the Cantonal Court, the statement said. According to the Federal Supreme Court, the decision of the cantonal court is wrong, since an unlawful granting of an advantage and an unlawful acceptance of an advantage by public employees are always mutually dependent.
Pierre Maudet and Patrick Baud-Lavigne, aware that they were not entitled to the benefit granted, resigned themselves to benefiting from it because of their official functions. They are said to have made themselves guilty of accepting an advantage. According to the Federal Supreme Court, Magid Khoury and Antoine Therefore, who became active as part of the travel invitation, are to be convicted as perpetrators or accomplices for granting advantages.
The Federal Supreme Court made a different judgment in connection with the financing of a survey in 2017. According to the Federal Supreme Court, this was political financing that was not granted to Pierre Maudet as a public official, but as a candidate with regard to the cantonal elections.
