C. Europe asks Andorra that the mediator can examine the constitutionality
Paris, Oct 24 (EFE).- The Venice Commission of the Council of Europe advises Andorra that the mediator (Raonador del Ciutadá) be given powers to be able to propose an examination of the constitutionality of laws or regulations before the Constitutional Court.
In an opinion published this Monday in response to a demand from Andorra before carrying out a reform of the mediator’s law, the Venice Commission is committed to constitutionalizing different aspects of its operation.
It is that the creation of the institution, its mandate, as well as the election and resignation procedure are contemplated in the Magna Carta to guarantee its independence at the highest level.
To align the law on this figure with international standards, this advisory body of the Council of Europe specialized in constitutional issues recommends that the mediator have access to all relevant documents.
That must implicate those who might be “privileged or confidential.” They should also have physical access to spaces over which they should be able to exercise their control function, such as detention centers.
The Venice Commission also insists that it must have the necessary resources to work and that the law should better regulate its appointment and dismissal than it does now. That should translate into “higher qualified majorities” for his appointment and revocation, with “clearer and more consistent” procedures to replace him. EFE
