Gaißau: Vortex after the removal of a snow groomer

Angry citizens blocked the state road in Krispl-Gaißau (Tennengau) on Friday evening to stop a truck belonging to the former owner of the Gaißauer Bergbahnen. The entrepreneur had a snow groomer removed. According to the insolvency administrator, the procedure is illegal, the mountain railways have been in bankruptcy since Friday.
Around 9:00 p.m. on Friday, a truck from the Eibl transport company loaded with a snow groomer was on the state road. The caterpillar comes from the fleet of Gaißau mountain railways. Neighbors observed the transport, recorded a video and blocked the road. The driver then parked the heavy vehicle and left.
Municipality is considering charges against unknown persons
The police were also informed and documented the events and are now determining whether there is a criminal offense. There is also a suspicion that traffic signs could have been damaged when the wide snow groomer was removed.
The Krispler Mayor Andreas Ploner (ÖVP) also received the video of the transport on Friday evening: “I was completely surprised by the action and didn’t know anything about it. According to my legal understanding, you shouldn’t do something like that. We will take pictures of the damaged traffic signs on Monday and file a complaint against unknown persons with the police.”

“Illegal because bankruptcy proceedings are already underway”
The bankruptcy proceedings against the Gaißauer Bergbahnen were only opened on Friday – the leased snowcat was only picked up when the company was already bankrupt. According to bankruptcy trustee Wolfgang Hochsteger, this is illegal: “According to the provisions of the bankruptcy law, no creditor may simply pick up objects, even if he claims ownership rights to them. This is not provided for under the bankruptcy code and is therefore illegal.”
Ex-CEO relies on power of attorney
The former managing director of the Gaißauer Bergbahnen, Bernhard Eibl, has a different opinion: he prevents the ORF from giving the leasing company a power of attorney, which is dated the end of July. He hadn’t got around to picking up the snow groomer yet, said Eibl, adding that he’d already taken a minibus away without anyone getting upset. Insolvency administrator Hochsteger announced on Saturday that the matter would be clarified in the coming days.
