Deportation to Azerbaijan “against child welfare”

In the case of Husein, who was deported from Salzburg to Azerbaijan six months ago, the supreme court must now decide. When the now 14-year-old student was deported, the best interests of the child were not taken into account, says his lawyer Wilfried Embacher.
Embacher also represented 12-year-old Tina, who was deported from Vienna to Georgia. The Federal Administrative Court recently ruled that the deportation was unlawful. The girl now lives with a host family in Austria.
Now supporters of Husein, who was deported from Salzburg, are also hoping for a solution in the interests of the 14-year-old. The Children’s Rights Commission found that the best interests of the child were not taken into account in his case. Husein is a gifted young table tennis player. Before his deportation last February, he lived in Austria for five years. The student was well integrated in Salzburg.
Lawyer: Residence should have been granted
Lawyer Wilfried Embacher is convinced: “I am of the opinion that in the case of Husein, too, if the Federal Constitutional Law on Children’s Rights was applied in accordance with the law, the result should have been that his child’s well-being should be given special consideration by granting him residence in Austria . Then this procedure could have been concluded positively.”
There is currently an entry ban against the 14-year-old. This was justified by the fact that his maintenance was not proven – i.e. due to a lack of financial means, says the student’s lawyer. In order for Husein to receive a student visa, the entry ban must be lifted – the Constitutional Court WILL decide on this in the autumn.
