After the Court of Auditors’ criticism of an incompatibility in the housing rights arbitration board of the city of Salzburg, the magistrate reacted: A clerk who was also the chairman of a homeowners’ association returned as a result of this office. However, he may remain a part-time expert.
The gross incompatibility in the arbitration board for housing law issues in the city of Salzburg prompted criticism from the Federal Audit Office in July. One of the employees should mediate in disputes between tenants and landlords. At the same time, he was also chairman of a homeowners’ association and acted part-time as an expert for homeownership issues.
The HR department of the city of Salzburg knew about it – and even officially approved these activities, despite the obvious incompatibility. The Federal Court of Auditors criticized this sharply – and even named a case in which this incompatibility resulted in a legal conflict.
Expert only outside the city limits
The Salzburg city administration now pointed out in a statement that the grievance had long been needed – it was still ongoing during the investigation by the Court of Auditors.
However, the magistrate’s lawyers only come up with a half solution: the clerk concerned must resign from his or her functions in the homeowners’ association. However, he may continue to work as an expert – but only outside the city limits, emphasizes a spokesman for the magistrate. The municipal arbitration board is only responsible for disputes in the city anyway. The magistrate finds that there can no longer be bias.
