Department: Action report against OGH Vice President “in the house”
There is a side report against the Vice President of the Supreme Court (OGH), Eva Marek. This was announced today by a public prosecutor who is assigned to the public prosecutor’s office (StA) in Innsbruck in the ÖVP-U committee. When asked by ORF.at, the Ministry of Justice confirmed that the report was already “in the house”.
It is about an initial suspicion test, i.e. the question of whether investigations will be initiated after this. The corresponding project report has just been examined. The ministry did not provide any further details. Marek was an informant on the U committee today.

There is now also an area report on the case surrounding the suspended head of the judiciary section, Christian Pilnacek. The Justice Department did not provide any further information. According to the public prosecutor of the StA Innsbruck, the activity report has been in existence for six to eight weeks.
It is not known whether the question is about an attitude or an indictment. It is not yet available to the Ministry of Justice – so the Innsbruck Public Prosecutor’s Office is likely to deal with it.

“Not part of a particular system”
After the prosecutor, Robert Jirovsky, department head at the Justice Department, was questioned in the U-Committee. Jirovsky wrote “well” with Pilnacek for years. The ex-head of section always appreciated the opinion of the specialist department – “at eye level, he wrote a lot with emails, but that was also known,” said the informant.
He knows of a “Pilnacek system” as an attribution, but never accepted such a system. “I’m not part of any particular system of personal names,” Jirovsky said, responding at length to questions.
The chauffeur listening
In the K. case, the legal opinion differed from that of Pilnacek, according to the department head. Due to a reorganization of the ministry, several management positions were advertised in 2015 – K applied for one position. Not only the then Minister of Justice Brandstetter is said to have taken part in the hearing, but also a chauffeur from the department. K. didn’t get the job and complained.
Years later, the Federal Administrative Court (BVwG) K. was right. According to the decision, the hearing had to serve as “a fig leaf for the different decision against the first-ranked complainant”.
In an e-mail to Pilnacek, the experts in the ministry advocate reporting Brandstetter. But he had failed to do so – this was only recently announced. Now the ministry itself had reported its ex-head of section. According to prosecutor Jirovsky, that was correct.
Examination of the WKStA work
He cannot say much about an instruction from the ÖVP Minister of Justice Josef Moser shortly after the publication of the “Ibiza” video. He didn’t belong to the “closer circle” where something like this was discussed. With the instruction, Moser wanted, he said in the “Ibiza” sub-committee, to firstly conduct external communication in a uniform manner and secondly to have an initial suspicion checked.
He was also commissioned by Pilnacek or the Moser cabinet to examine the quality of the work of the Economic and Corruption Prosecutor’s Office (WKStA). According to Jirovksy, he was of the opinion that most of them work solidly and properly there, but there were also a few things that went wrong.
Green mandatary David Stögmüller wanted to know whether Jirovsky had ever received such a request for review during his many years in the Ministry of Justice. The prosecutor said no, but he can’t say for sure.
