Government approves report and application for the transfer of Liechtenstein family assistance to a public foundation
At its meeting on May 3, 2022, the government approved the report and motion regarding the creation of a law on family assistance in Liechtenstein.
The draft law or the law on Liechtenstein family assistance (FHLG) provides for the establishment of an independent foundation under public law while retaining the previous name of the association “Family Assistance Liechtenstein”. The purpose of the foundation is in particular to guarantee the best possible outpatient care, support, support and advice for those in need of care and nursing who live in the country.
Application for restructuring
The background to the establishment of an independent foundation under public law is a corresponding application by Familienhilfe Liechtenstein eV. The planned foundation under public law is to assume all the rights and obligations of the existing association under private law.
Independent board of trustees planned
The governing bodies of the foundation are the foundation board, management and the auditors. In addition, a strategy council is responsible for determining the basic strategy, including the key figures for financial planning. The Strategy Council consists of the heads of the eleven municipalities.
Deviating from the draft for consultation, the Liechtenstein Family Aid should have its own foundation board that is independent of the Liechtenstein Elderly and Sick Aid (LAK). In order to ensure that the strategic decisions in the areas of outpatient and inpatient care and nursing are made in full, the chairman of the strategy council and the president of the foundation council of the LAK should be able to take part in the meetings of the foundation council for family support in an advisory capacity. Conversely, the people who hold these positions in family assistance should be given this opportunity at the LAK.
Simultaneously with the creation of a law on family assistance in Liechtenstein, the law on Liechtenstein old-age and sickness assistance (LAKG) and the law on supplementary benefits for old-age, survivors’ and disability insurance (ELG) are to be amended insofar as this is necessary and sensible.
