The events were obviously too stressful – the 37-year-old defendant said in court on Tuesday that he had no memory of his shots at one of the police officers – he himself woke up in the hospital with two gunshot wounds. He had a behavioral disorder and he never thought that his drug mixture of cannabis and cocaine would have such consequences, the man protested.
Under the influence of drugs, he rioted in his parents’ house
Under the influence of drugs, the then 37-year-old rioted in his parents’ house in the Leopoldskron district of Salzburg. When two police officers arrived, the victim snatched the service weapon from one of them and shot him several times. The second police officer then shot the rioter. Two serious injuries were the result of the crime.
“My client has now been free for a year and a half and is following all instructions regarding therapy and medication. He is fully integrated again and just wants to continue his normal life and not in the closed psychiatric ward,” said Kurt Jelinek, the man’s defense attorney.
Associate Judge: “Coupling and Self-Pity”
However, the associate judge called these statements highly euphemistic and self-pitying. She wouldn’t like his condition at all, the judge said.
Admission to Psychiatry on probation
The public prosecutor’s office submitted an application for accommodation in an institution for mentally abnormal, irresponsible offenders, that is, in a closed psychiatric ward, from which release is only possible if the doctors allow it.
Tuesday’s trial ruled that the 37-year-old’s confinement to a closed psychiatric facility WILL be suspended on probation while he has 10 years to prove his treatment. The policeman who was shot is back on duty.

The policeman who was shot said they wanted to help the man who was screaming for help – but suddenly he had a gun in his hand and shots were fired. He wanted to draw his service weapon, but reached into the void and thought, “Now it’s over”. His colleague, on the other hand, who fired at the rioter, stopped because the situation at the time was still too stressful for him.
Rioters last at large, treated as an outpatient
Most recently, the rioters were at large and received psychiatric outpatient care. A charge against the 37-year-old for attempted murder of a police officer and a minimum sentence of ten years in prison were not possible because a court report had justified him as not being of sound mind.
