Verona. Scarred rider, for Inail it is an accident at work: “Saving a woman, a duty”
Stefania Marconi, the director of Inail of Veronaputs it this way: “It is a correct choice from a legal point of view, but above all it wants to be a message: the state supports the value of solidarity and takes sides with those who have the courage not to turn away ». Inail recognized the accident at work the deep wound in the face remedied by a Veronese rider to defend a girl at the mercy of two bullies. It is the first case of this type.
The reconstruction
The news is well known: on April 17 last year, 22-year-old Michele Dal Forno had just delivered pizzas to an apartment just outside the historic center of Verona, when he noticed a location in difficulty. “There were two teenagers and she seemed scared – he said – so I went over and asked if she was okay”. One of the bullies, an Albanian minor, approached him with a knife in his hand. “It was a question of a moment. The blade cut my cheek neatly, from my nose to my ear. ‘ A scar that she will have to deal with throughout her life.
Tenacious boy
The attacker, arrested by the police, has returned free a few months ago with a provision of “probation”. Michele, on the other hand, was taken to the hospital where fifty stitches were needed to close the wound. In recent days we have returned to talk about the episode because Dal Forno has a “new” face: three speeches – two with laser and one with lipofilling – almost completely erased the scar. Thanks to the tenacity of this boy, but also to the wave of solidarity that raised his case: the owner of the pizzeria for which he works a fundraiser and in a few weeks donations for one hundred thousand euros arrived from all over Italy. Now it turns out that Inail also played the part of him, compensating him with a figure that is around 30 thousand euros. It was not obvious because, while it is undeniable that the rider at that time was in “service” time, it is true that defending a person in difficulty was certainly not one of his duties. Technically it is defined as “elective risk injury”, in practice it is the hazard that the worker takes on a personal initiative that has nothing to do with the job he has to perform. And, except in particular situations, he is not compensated by the Institute.
So many cases
«Cases of this type – explains the director – unfortunately there are many. Recently it was not possible to recognize the accident to a railway worker that he had twisted his ankle crossing the tracks: it was his free choice not to use the underpass. Or the incident that happened to a bricklayer who, with a colleague, had a nice round thought to engage in a race to see who got off the scaffold first.to: to win he threw himself from the scaffolding breaking his foot. So, she went male also from an insurance point of view ». Opposite judgment for Michele Dal Forno, to whom Inail has decided to repay both the temporary infirmity (a month of convalescence, immediately after the scar) that, more recently, permanent biological damage. «Riders are guaranteed by our institute only from 2020, and generally their injuries are related to road accidents or falls from the bicycle. A case like that, with a boy who is injured for defending a woman in troubleit had never happened to us before »explains Stefania Marconi.
“The right decision”
Inail of Verona contacted the central management of Rome, which analyzed the case. After some time, the institute’s team of experts and lawyers responded with a document that puts on paper what should be a principle of civilization: “Mr. Dal Forno found himself in the place where the obligation to help a third party arose who appeared in conditions of imminent danger” and therefore the accident “must be considered a direct and immediate consequence of a situation aimed at fulfilling a moral duty, which is to render aid. For this reason, he cannot be considered an arbitrary gesture “. Translated: saving a woman in distress is not a free choice, nor can it be a simple option to play on the table of life a second of the situations and commitments (including work) that are being faced at that moment. It is a duty, or so it should be in everyone’s eyes. “Despite that scar he did not get by carrying out the duties of a rider – concludes the director of Inail – Dal Forno has kept faith with a higher obligation of a moral and ethical nature. I find it was the right decision. Especially in a period like this, it is nice to know that solidarity is such an important value that it is also “protected” by the laws and regulations of our country ».
