the undersigned citizens promote this Arengo application, so that the right to independent life for non self-sufficient people with disabilities is fully affirmed in San Marino. “Independent Life” means the set of measures to guarantee people with disabilities the right to live in the community with their own freedom of choice and control over life in equality with any other person without disabilities, with the maximum possible of their own self-determination . Persons with disabilities have historically always been denied their own personal choice and individual control in all areas of life. It has been assumed that many of them are unable to live independently in the collective. Resources have always been invested in institutions or other services, which unfortunately have not developed concrete possibilities for people with disabilities to live independently in the community. And this has gradually led to abandonment, dependence on family, institutionalization, isolation and segregation. The United Nations Convention on the Rights of Persons with Disabilities, ratified by the Great and General Council on 29 January 2008, in art. 19 (Independent living and inclusion in society), recognizes the right of all people with disabilities to live in society with the same freedom of choice as any other person.
This right is profoundly radical in other international human rights treaties, starting with the Universal Declaration which underlines in article 29, the interdependence of the personal development of each individual and the social aspect of being part of the community: “Everyone the individual has duties towards the community only if the free and full development of his own personality is possible within it “. In the Declaration of citizens’ rights and the fundamental principles of the San Marino legal system, it is established, among other things, that the Republic ensures equal social dignity and equal protection of rights and freedoms and promotes the conditions for the effective participation of citizens in life. economic and social of the country. The first national recognition of “Independent Living” is explicitly based on Law 10 March 2015 n. 28 to article 4 A and in the Delegated Decree 1 February 2018 n.14 to article 12 bis point A, concerning self-managed personal assistance projects, aimed at guaranteeing this right point to people with permanent disabilities and severe limitation of personal autonomy in carrying out one or more essential life functions.
Exc. To the Captains Regent, considering that:
– we are one of the few Westerners where this right is not yet fully guaranteed; – the right to an independent life belongs to any human being, with or without disabilities; – The right to an independent adult life must be guaranteed for all people with disabilities, regardless of their physical, economic and social condition. Independent life is also possible for people with intellectual disabilities or neurodevelopmental disorders who, with the right support and support, can be enabled to leave their choices and their self-determination;
– the self-managed programs of life independent of the segregating situation, address the burden in terms of psychological distress and, relational distress, work and economic distress, assistance of a physical nature and constitute an economic advantage towards institutions and society as their costs are lower than the costs of direct home care and those related to institutionalization;
– independent living projects create employment. ask that the right to independent life be affirmed in San Marino for non self-sufficient people with disabilities.
In particular, the introduction of a legislative text in the San Marino legal system is requested
– in application of art. 4 point A of the Law 10 March 2015 n. 28, and of the art. 12 bis letter A of the Delegated Decree 1 February 2018 n. 14 – concretely realize, in favor of people with disabilities, forms of independent and self-determined life through self-managed personal assistance, in cases where this is possible and in the ways and conditions that will be specified by the rules of the text of this Instance and also possibly by the relative Regulation.

the undersigned citizens promote this Application of d’Arengo, so that even the people with disabilities of San Marino, holders of parking cards for the disabled, can use the Public Register of the European Disability Pass (CUDE).
The CUDE is governed by the 1998 Recommendation of the European Council n. 98/376 / CE, both countries that in paper format introducing the current unified mark in blue color and valid in all the European Union, and in digital format considering the arrival of new technologies, internet in particular. The paper version, however, did not facilitate the life of people with disabilities as it should, because whenever they had to enter / stop in a ZTL (Limited Traffic Zone) outside their place of residence, it always obliges them to register and communicate the license plate of your vehicle a few days in advance. Well, already several of Europe are stannondo the country version, that is a unique code provided by a specific application upon presentation of the medical documentation certifying the disability and the data relating to the vehicle license plate.
In this way, the double advantage is obtained of relieving people with disabilities from the aforementioned obligation and of moving / stopping freely in the countries of the European Union without running the risk that some States do not recognize the validity of paper documents. In Italy, for example, with the Decree of 5 July 2021, the single national IT platform was established and will be completed and operational by the end of this year. This is the Public Register of the European Unified Disability Pass – CUDE (www.registropubblicocude.it) which, while respecting privacy, will simplify procedures in a very significant way, avoid abuses, counterfeiting and the risk of being unjustly sanctioned. It will therefore significantly facilitate the mobility of people with disabilities in Italy and Europe.
In San Marino, the parking card for the disabled issued by the relevant Offices complies with the model adopted in Europe (Article 3 of the Delegated Decree of 26 May 2008, n.81). etc. mi Captains Regent, the creation of a similar national platform for obtaining the digital sign is undoubtedly an optimal solution, also with a view to a review of the entitled parties in line with the indications contained in the United Nations Convention on rights of people with disabilities.
However, in order to also allow San Marino citizens and families to access these innovative procedures, we ask the competent San Marino authorities, Secretariats of State and Offices, to take action in order to explore through the stipulation of agreements with other countries, in particular with Italy, the possibility for people with disabilities in San Marino, holders of badge, to interface electronically with these digital platforms.
