The Secretary of State for the Territory and the Environment, Stefano Canti, reminds that the protection and prevention of damage to the environment are among the priorities of his Secretariat, with particular attention to waste management activities. In this regard, the recent changes made to the Environmental Code with the DD 20 May 2021 n.91 have responsibility towards producers and companies that manage waste, introducing tools to guarantee greater protection and aimed at the State in case of non-compliance. of the regulations and bankruptcy of the companies themselves.
Thanks to these important changes to the regulatory warehouse, in March 2021 the clearing and disposal of the waste deposited by the former Beccari Srl company in the warehouse owned by BAC in Murata were completed. Works in which the State, it should be remembered, did not have to intervene with financial support: the reclamation procedures were carried out by the property owner or by the Commercial Agricultural Bank.
Subsequently, last August 2021, the owners of the property located in Via Rio Cerbiano n.21 were notified of an order for the adoption of prevention, remediation, repair and safety measures for the site. inside of which the waste is still stacked.
Since the owners of the property have not complied with the requirements of the higher ordinance and that the waste stored in the ex-Beccari srl site has resulted in serious conditions of hygiene, pollution and public safety with imminent threat of environmental damage for the possible leakage of liquid waste with high danger to the environment, the Civil Protection Coordination, in order to protect the safety and public health of citizens, has resolved to promote prevention, remediation and repair measures. Therefore, in fact, the Civil Protection Coordination has mandated AASS and AASLP to define the joint prevention, remediation and repair interventions, with particular reference to waste, deposited inside the building, which has a elevator risk of fire and put environmental matrices at risk of pollution.
It is right to remember that, thanks to the introduction of article 27 bis in the Environmental Code, the State can claim environmental expenses incurred for the repair and remediation activities on those who make themselves responsible with their threatening activities. the initiation of procedures for expropriation of the property, in order to recover the costs incurred for the reclamation and for any greater damage suffered. Expropriation procedure that the Commission for Territorial Policies will adopt tomorrow in a specially convened session.
