“The Judicial Council truly becomes the center of the independence and autonomy of the Judiciary”
“It’s a historic momentthe people of San Marino supported him as such and therefore I too would like to do “. Thus the Director of the Court, prof Giovanni Canzio on the day of the inauguration of new Judicial Council. “It is true that I have only been in San Marino for a short time, but I have lived through the experience of the previous Judicial Council and certainly the innovation is radical, as can be seen immediately from theaesthetic-visual impact: the first classroom was completely full on all benches, there were all the magistrates, all the members of the Commission of Justice, today there are four togates and four “lay” members, in addition to the Captains Regent and the Director of the Court “.
“The reform – adds – and in any case very penetratingvery deep for Which bring the San Marino Institution of Justice into Europe. When will the GREEK, the international body that comes to verify the compatibility of national systems with the European one, we think we will present ourselves with the cards in place, even if we are very ready and willing to listen to GRECO in case there are other changes to be made. But the news are very important: first of all because the Judicial Council truly becomes the center of the independence and autonomy of the Judiciary, everything becomes more manageable with transparency and simplicity because the more magistrates present within the body, the more they make cases of incompatibility in dealing with the cases as judges in the Court. Politics is appropriate with prestigious appointments which then arises from the Great and General Council the novelty having structured it much better, not only rights, freedom of judgment, but duties and responsibilities, therefore disciplinary proceedings, disciplinary sanctions; as well as the role and functions of the Manager of the Court, especially if external as in my case, here too powers, but also many duties and responsibilities. And also relations with the Justice Commission, politics, the Secretariat of State for Justice with theAdvocacy in my opinion you receive greater transparency. I want to say that this reform is the fruit of a project developed by magistrates, lawyers and academics together who unanimously proposed it “.
We have come from difficult years for the justice sector: strong internal disagreements within the Court and with politics, often skyrocketing tension. What are your wishes for the upcoming season?
“Mine are not just wishes because I have already noticed and for some months that the climate was – useless to hide it – of profound opposition and laceration within the Tribunal and between the Tribunal and the outside political world, a climate that has now largely tempered. What I appreciated is the empowerment of all the protagonists of these events, I speak in particular within the Court, in bring the Court itself back into a perimeter that belongs to the jurisdiction. I do not want to speak of a paradisiacal climate, but of a climate in which certainly the aim pursued – that is, the service of the jurisdiction of the citizens – is primary over any other distinction. Each has his own personality, each judge has his own, prestige and authority but all together we work to offer answers – sometimes even inadequate, we must recognize our mistakes – but in any case constant and daily the goal is just that, not only an omen. The reform of the Judicial Council, the reform of the criminal process, the code of conduct for magistrates are all dowels which ensure that as far as the justice sector is concerned, San Marino is in step with other European states, be they small or large. I believe that a testimony of all this is the presence, next April 1st, of the Italian Minister of Justice Marta Cartabia as Official Speaker at the Inauguration Ceremony of the Captains Regent. In those days San the Republic of San Marino and the Italian Republic will enter into important agreements for the justice sector “.
