San Marino. The first Judicial Council is established after the reform
At 13.00 today, the Exc. Captains Regent, Francesco Mussoni and Giacomo Simoncini, presided over the installation of the Judicial Council, recently appointed following the entry into force of the reform of the Judicial System introduced with the Constitutional Law 7 December 2021 n.1.
The Institutional Secretariat gave the news, specifying: “All eight members of the same Council were present – the 4 elected Magistrates and the 4” lay “appointed by the Great and General Council in the session last February – and the Executive Magistrate who is part of it full title “.
The Regency, the note reads, “in addressing its greeting address and best wishes for the good work, wished to underline the importance of the Judicial Council as a body that guarantees the autonomy and independence of the judiciary, also highlighting how, ‘the day after the completion of the appointment of all his members, he has promptly decided on today’s settlement, so as to be, not only on paper but also in practice, perfectly compliant with the new provisions envisaged in our legal system and with the international provisions that such provisions have transposed.
Full agreement in recognizing the Judicial Council as a point of reference for all jurists, a place where not only rights, powers and authorities are affirmed, but also duties, responsibilities and sanctions “.
The Regency and the Judicial Council, the note continues, “have therefore unanimously shared the proposal of the Executive Magistrate of solidarity and closeness to the Ukrainian people and in particular to the class of Ukrainian jurists – to the Magistrates, lawyers and prosecutors – who right now they are doing an extraordinary job for the battered community, gathering evidence of the atrocities perpetrated against civilians and providing legal assistance to those forced to leave their country “.
“In today’s session – as also underlined by the Captains Regent – not only was a formal response given, but important resolutions were also adopted. First of all the unanimous approval of the Code of Ethics of San Marino Magistrates. Subsequently, a sub-commission was appointed for the elaboration of the internal regulations which must be approved by the Judicial Council and which must regulate the organization and functioning. Finally, the reissue of the call for the recruitment of an Appeal Judge – alternate – for the Civil Liability of Magistrates was resolved ”.
