Implementation of judgments of the European Court of Human Rights
The Committee of Ministers of the Council of Europe is holding its quarterly meeting to monitor the execution of judgments and decisions of the European Court of Human Rights in Strasbourg from 8 to 10 March. Cases proposed for detailed examination concern Albania, Armenia, Azerbaijan, Bosnia and Herzegovina, Bulgaria, France, Georgia, Greece, Hungary, Iceland, Italy, Lithuania, Malta, Poland, Romania, the Russian Federation, Serbia, Turkey, Ukraine and the United Kingdom.
The decisions taken by the Committee of Ministers during the meeting will be published on the Council of Europe website after the end of the meeting. Under Article 46 of the European Convention on Human Rights, judgments of the European Court of Human Rights are binding on the states concerned. The Committee of Ministers monitors the execution of judgments on the basis of information provided by national authorities, applicants, NGOs, national human rights institutions (NHRIs) and other interested parties.
To note
On 25 February 2022, the Committee of Ministers decided to suspend the rights of representation of the Russian Federation in the Council of Europe because of its aggression against Ukraine. The Russian Federation remains a party to the European Convention on Human Rights and has the obligation to implement the judgments of the European Court against it. So, Resolution CM/Res(2022)1adopted by the Committee of Ministers on 2 March 2022, stipulates that the Russian Federation may continue to participate in the meetings of the Committee on the execution of judgments of the Court with a view to providing and receiving information concerning the judgments to which it is a party only, without the right to vote or participate in the adoption of decisions.
