From February 1st, basic green pass to go to public offices
As indicated by the legislator, the new decree has inserted a paragraph (1-bis in art.9-bis of Legislative Decree 22 April 2021, n.52) which appoints that as of 1 February 2022, users of services who intend to access public offices by issuing associates and one of the Covid-19 green certifications, including the one included by accepting an antigenic or molecular pad with a result (so-called basic or weak green pass).
From February 15 compulsory vaccine for workers over 50 to access workplaces
In order to protect the health and safety of workers in the workplace, the decree of 7 January 2022, n. 1, reshapes the previous legislation on Covid-19 green certification, establishing that starting from February 15, 2022, for the access of workers over 50 to public and private workplaces, the basic green pass will no longer be sufficient or weak, only workers who are in one of the following conditions can enter the workplace:
– anti-SARS-CoV-2 vaccination occurred, at the end of the primary vaccination cycle (even with the first dose, after 14 days from the relative administration) or at the administration of the relative booster dose;
– successful recovery from the COVID-19 disease, with the simultaneous termination of the period of isolation;
– recovery from the disease after administration of the first dose of vaccine or at the end of the primary vaccination course or administration of the relative booster dose.
The vaccination obligation concerns personnel who have reached the age of 50 and who are therefore added to the personnel already provided for by the previous law (personnel of the local police structures and of the preschools and infant-toddler centers, for these categories of personnel the vaccination obligation remains confirmed also for personnel under 50 years of age). The obligation to possess and exhibit the enhanced certification is extended not only to the employees of the Entity, but also to all subjects “who carry out, in any capacity, their work or training or voluntary service at the administrations referred to in paragraph 1, also on the basis of external contracts “. It follows that workers subject to the vaccination obligation (over 50 of all services, school and educational staff, belonging to the local police and AFAM) who do not have the reinforced green certification, as well as being subject to the application of the sanction that will be imposed by ‘office of the Ministry of Health through the Revenue Agency which provides for it, will not be able to access the workplace (see art. 4-quinquies, paragraph 5 of Legislative Decree 44 of 2021) and will be considered “unjustified absentees, without consequences disciplinary and with the right to retain the employment relationship, until the presentation of the aforementioned certification, and in any case no later than June 15, 2022. For the days of unjustified absence, no salary or other compensation or emolument, however denomination, is due “. The law also specifies that, with a decree of the President of the Council of Ministries, the services “necessary to ensure the satisfaction of essential and primary needs of the person” will be identified within fifteen days from the date of entry into the law, for access to which citizens will be exempt from the obligation of green pass.
Staff of the Higher artistic and musical training of the Giovanni Lettimi Institute
The same decree law 7 January 2022, n. 1, art. 2, extends, with effect from 1 February 2022, the vaccination obligation for the prevention of SARS-CoV-2 infection to the staff of institutions of high artistic, musical and dance training. It follows that all those who work at the G. Lettimi Musical Institute are subject to the obligation, including employees assigned to executive, auxiliary and administrative duties.
