The defendant’s defense attorney, Klaus Estl, emphasized that his client was “not a typical criminal dealer”: “He has a positive outlook for the future and a good education.” The 48-year-old, who most recently worked as a freelancer, pleaded fully guilty to the incriminated drug offenses. He also emphasized that he had already been in custody for a good six months: “The detention is terrible. It burdens me a lot.”
The lay judge sentenced the native of Salzburg to 30 months of partially conditional imprisonment (final). He was released on Monday because he had already served the six months’ custody sentence that was strictly imposed.
The 48-year-old was also accused of fraud: from April 2020 to January 2021 he is said to have stolen 5800 euros from the Covid-19 hardship fund for the self-employed. But there was an acquittal for lack of evidence.
