ANTONIO FABBRI – The story took place exactly 4 years ago, on January 18, 2019, in a commercial space in Via del Serrone. Due to the non-payment of the rent, the shop owner had gone to the site with the intention of changing the lock. At that juncture the owner of the business had arrived together, who had tried to push the man away from the door. An uproar in which the man, declared the woman yesterday witness in the courtroom, had put a hand on her neck.
Seeing this, the partner of the business owner, who had accompanied her to the shop, had intervened by punching the man in the left temple. A punch that caused an important injury to the man, considering that the woman who threw it had worn a pair of scissors as brass knuckles, thus hitting the man with the part of the handle and causing an important laceration and the copious bleeding, with a consequent prognosis of 25 days.
Yesterday the trial for these facts before the Law Commissioner Adriano Saldarelli. Having listened to the witnesses, we moved on to conclusions. The lawyer Luca Bigiolifor the civil part, it highlighted that the criminal liability of the defendant had been ascertained and asked for the payment of the costs and fees of the civil part and compensation for damages to be liquidated in civil proceedings except for a provisional payment of at least one thousand euros.
The Attorney of the Tax Office, Roberto Cesareni, in turn highlighted how the disputed fact was proven, also noting the dangerousness of the conduct given that the blow was delivered by brandishing the forici. “If they had been used on the tip side we would have had very different consequences”.
The condition of the defendant who lives in Milan and who, according to what emerged from the testimonies, is also without a fixed abode and presents a criminal record with various previous records was also detected by the Pf. The Pf then asked for a one-year prison sentence and the payment of court costs.
The Defense Attorney at the Office, Antonio Masiello, recognized the reconstruction of what happened as correct and admits that the gesture of the defendant, who was in contumacious at the trial, was an imprudent gesture. However, the defender has minimal “contribution from the offended party, who has engaged in non-urban or civil conduct, effectively provoking and attempting to assemble or disassemble the lock, with a rental contract still in progress, and it is not lawful going to carry out an action of this type, a sort of reason made by the injured party. I consider asking for the minimum penalty, however not beyond the requests
Judge Saldarelli, accepting the pf’s request, sentenced the woman in absentia to one year of imprisonment, to pay the costs of the proceedings, civil costs and compensation for damages to be liquidated separately by setting a provisional amount of 1,000 euros.
