The allegations are happy: According to the indictment, the 24-year-old commercial clerk from the Zurich Oberland drove in June 2020 together with 14 other GC fans in three cars to the VBZ stop Butzenstrasse in Zurich-Wollishofen. There, the hooded hooligans attacked three 17-year-old FCZ supporters and beat them with fists and kicks, making them hospitalized.
On Monday, one of the GC hooligans stood before the Zurich District Court – the only one who could be identified by the police. A third person photographed the incident. The license plate could be seen in the picture – the suspect’s father’s car. The 24-year-old refused to make any statements at the trial, as he did during the investigation.
“Act of senseless fan violence”
For this, the public prosecutor forgives his evidence. “Any indication alone is not enough for a conviction. But the whole gives a mosaic and shows that he is one of the perpetrators, »said the prosecutor. The suspect’s cell phone logged on near the scene of the crime. The hooligans were filmed in the three cars not far from the crime scene at a gas station, where the three FCZ fans were. They followed the FCZ supporters and brutally beat them at the tram stop.
“It was a cowardly and planned action – an act of senseless fan violence,” said the prosecutor. The mobile phone evaluation also showed that the accused was wearing the same T-shirt as in a mobile phone picture. All this would be certain that he was at the scene of the crime.
One of the three youths experienced a concussion and a crushed kidney. He was in the hospital for two days, unable to work for three weeks and had to repeat a year of training. The second also reported a concussion and the doctor wrote him off work for three days. The third victim was kicked in the back and required medical attention.
FCZ cap as a trophy
During a search of the accused’s house, the police found an FCZ cap, which he is said to have captured as a trophy, as well as a forbidden steel rod and smoke petards. She also discovered 32 names and addresses of FCZ fans on his cell phone, a “Most Wanted List”, as the prosecutor called it. More information and photos from FCZ fans came to light on his Telegram chat. According to a report by the city police, the man is an active member of a violent GC gang. “He even tattooed their names,” said the prosecutor.
He demanded a two-year prison sentence for the Swiss, who had previously been convicted of assault, – absolutely. In the indictment he had absolutely demanded 16 months, but increased the sentence at the trial. This was justified by the fact that the accused showed neither remorse nor insight and that culpability weighed heavily. In addition, a fine of almost 4,000 francs is to be called up and the accused must pay the investigation costs of 8,200 francs.
“It was a planned, raid-like and concerted approach”
The defender of the 24-year-old criticized the length of the investigation and the required sentence. “The case was started by the prosecutor as a minor case and now he is tightening the criminal complaint.” This is a violation of loyalty and faith. He calls for the case to be dropped or an acquittal. “Mere sympathy for a football team is not punishable,” said the lawyer. The evidence would not be enough for a conviction. Therefore, his client should be acquitted according to the principle “In dubio pro reo”.
But the court wanted nothing to do with that. It sentences the young man to a suspended prison sentence of 17 months for assault and other offences. He also has to pay a conditional fine of CHF 3,000, which has been imposed in the past. There are also court and investigation costs of around 12,000 francs. The evidence shows that the suspect drove the car and took part in the robbery. “It was a planned, raid-like and concerted action – pointless, stupid and primitive,” said the presiding judge.
