The death of a judge from the Nanterre court, in the middle of a hearing, Tuesday, October 18, 2022, had a strong impact on the profession of magistrate. “This event has moved consciences and revived the wind of weariness blowing over the profession”, does not hide Marc Hédrich, deputy regional delegate of the magistrates union (SM).
Hearings overloaded, decisions applied months later
The trade union organization, in conjunction with the USM (Union of magistrates), calls for mobilization, this Tuesday, November 22, one after the launch of the Estates General of Justice “by the Keeper of the Seals, Éric Dupont-Moretti.
Today, concretely, the situation has never been so degraded.
The inter-union and inter-professional watchword (magistrates, registry officials, lawyers) describes “overloaded hearings which too often end in the middle of the night, delays beyond reasonable, judgments not explained, decisions carried out several months – even years – later. ” He deplores ” outdated courts and software from the 90s “, and ” magistrates who, despite attacks on their independence, give up their leave and their training to make their decisions, clerks and civil servants, relegated or precarious , who refuse to be paid for their overtime and lawyers forced to assist citizens in a degraded public service that they also suffer”.
These are professionals in the grip of a loss of meaning who are exhausted at work and litigants reduced to the state of “files” and “stocks”.
A gathering and dismissals
On the jurisdiction of the Caen Court of Appeal, the unions obtained the creation of a fifth post of Sentence Enforcement Judge, in view of the upcoming opening of the prison of Ifs, as well as a sixth post of judge for children. “But these positions have not yet been filled,” emphasizes Marc Hédrich.
To denounce “justice at a discount”, the trade unions therefore urging “all the magistrates to dismiss all hearings on November 22”. A gathering, in dress, is also planned in front of the Caen judicial court, at 12:15 p.m.
