Austrian judges study the coexistence of language groups
The judges of the Vienna Court of Appeal will experience examples of the coexistence of language groups during a study trip

Judges, prosecutors and prosecutors of the Vienna Court of Appeal are in Bolzano for three days for a study trip (“South Tyrol-Slovenia-Istria and the coexistence of language groups”).
The high-level delegation, led by Maria-Elisabeth Wanke-Czerwenka, president of the college of the Court of Appeal of Vienna, and the consul general of Austria in Milan, Clemens Mantl, was received today (3 October) by the president of the Arno Kompatscher province.
Also present were the former president of the Court of Bolzano, Elsa Vesco, and the long-term member of parliament and constitutional law expert, Karl Zeller.
«Our study trip is a look beyond our nose, an enlargement of our personal horizons, – said Wanke-Czerwenka. – Of course, we can come to South Tyrol as tourists. “
“But this professional trip is an opportunity to look behind the scenes” – said the president of the college of the Vienna Court of Appeal.
President Kompatscher, Elsa Vesco and Karl Zeller provided a special insight.
Kompatscher briefly presented the Autonomy of South Tyrol and then reported on the recent transfer of powers in the sector: the transfer of the administrative tasks of the judiciary to the Region in 2017.
“Implementation is still ongoing and it will also take many implementation protocols, the roles will not be clearly distributed”, – said Kompatscher.
An interesting aspect, he said, is also the right to use one’s mother tongue.
“In Austria there are some courts in Carinthia where Slovenian-speaking judges administer justice, – said Wanke-Czerwenka”. – However, there is no vested right.
Elsa Vesco defined the transfer of the powers of the administration of justice as “revolutionary”.
“However – he said – it will take patience to implement it.”
Karl Zeller offered an unusual insight into the path of Autonomy.
He focused on the psychological situation of the various actors – Vienna, Rome, Bolzano and Trento. Over and over again the balance of power has changed, the strong has become the weak and vice versa.
“Also from this point of view, dynamic autonomy should be treated with sensitivity and never give in to the temptation to simply pass over the weak from a position of strength”, – said Zeller.
