THE PROCEDURE WAS LAUNCHED IN 2018

On 31 July 2018, the Ligurian health authority and the single regional contracting station launched an open procedure for the awarding of the cleaning and sanitation service for the healthcare companies of Liguria, for a period of 48 months, with an auction base. just under 216 million. In 2021 all the lots were entrusted to Coop Service (the ASL 1 Imperiese and 2 Savonese is not, however, the subject of claims by the Leonardo Consortium because it is not included in the result of the Consip lot for which it is awarded). On this assignment, however, the appeal of Idealservice, second classified, intervened, which denounced some irregularity of the winner on the formal communication of criminal charges against him.

THE REGIONAL RACE IS NOT CONCLUDED YET

At the end of a judicial process at the administrative court, with a sentence in January and subsequent clarifications arrived in August, the Council of State agreed with the applicants and asked along Piazza De Ferrari to reassess the position of Coopservice. At the moment, however, the regional tender does not yet seem formally concluded. Leonardo comes into play on a parallel track, since, on the same service and in the same areas, in December 2020 the consortium was awarded a tender launched in 2014 by Consip, the purchasing center of the public administration.

AT THE BEGINNING OF 2021 THE LEONARDO CONSORTIUM WENT TO THE TAR

Following Alisa’s decision to proceed with an autonomous tender, at the beginning of 2021 Leonardo turned to the TAR of Liguria to challenge the award to Coopservice, considering its offer more economically advantageous for over 1.7 million per year. The hearing on this appeal is scheduled for 21 October, but the sentence could also be postponed, since Leonardo’s appeal concerns the original award of Alisa to Coopservice, while in the meantime the Council of State intervened on Idealservice’s appeal. for the regional tender: consequently, a possible sentence would be, in fact, not subject to prosecution.

“WITH US YOU COULD SAVE FROM 7 TO 10 MILLION IN 4 YEARS”

At the base of it all is a regulatory anomaly. The legal system, in fact, with the 2016 Stability Law, has allowed local authorities to decide, in the face of the most economically advantageous offer, whether to rely on the national conventions issued by Consip or whether to proceed with an autonomous tender. And it is right on theanalysis of the most economically advantageous offer that Leonardo’s action is engaged, as the consortium lawyer Matteo Valente explains to the Dire agency. “When the Region understood that it could no longer go ahead with entrusting it to Coopservice – says the lawyer – in April it opened a technical table of comparison, in the presence of all the interested parties, including Leonardo and Idealservice. We have documented that with our offer, the Region would achieve savings of four yearsequal to the duration of the Consip agreement, of 6.9 million if the successful tenderer for the regional tender were Coopservice and over 10.3 million if the successful tenderer was Idealservice“.

The Region, however, contested Leonardo’s calculations. From a criminal point of view, it is the applicants themselves who admit that they have no particular elements in their hands, but the call into question also the Public Prosecutor’s Office responds to the desire to clarify the correctness of the behavior of the Region and of Alisa. Otherwise, however, the question could be from the point of view of accounting justice. “We are suffering very serious damage from the fact that the Region has not yet closed the race: as winners of the Consip tender, we only have time until 20 December to enter into a possible contract with the interested entities. After that, we will find ourselves with a handful of flies – comments Filippo Morosi, vice president of the Leonardo consortium – a few days ago, the Region replied that, according to them, the savings we documented with our offer would not exist because we considered incorrect parameters . It does not seem true to us and we would like to demonstrate it in a normal contradiction that preludes to the assignment of the service. After two years in which we are behind this situation, spending time and resources, we have reached four months from our deadline and it all seems like a big joke. This is why we decided to raise the bar and rely on the two exhibited ”.
