The court upheld Prague’s fine of CZK 740,000 for parking rules for hybrid cars
The Regional Court in Brno upheld the validity of Prague’s 740,000 crown fine for the way it set the rules for parking cars with a hybrid drive. On Thursday, he dismissed the capital city’s lawsuit against the decision of ÚOHS chairman Petr Mlsný.
Court spokeswoman Klára Belkovová told ČTK.
According to the original decision of the Office for the Protection of Economic Competition, Prague had to pay 984,000 crowns, but MLSNA reduced the fine last March due to the shorter duration of the offense. 135 kW. “At the same time, this condition was not chosen on the basis of objective and non-discriminatory criteria. The negotiations of the capital city of Prague were capable of canceling economic competition in the territory of the Czech Republic, when it favored only those who sold vehicles with an engine power of up to 135 kW from sellers of hybrid cars,” he said in the decision of the authority.
In the first-instance decision of the office, the fine was set higher. However, Mlsna took into account the fact that, according to administrative courts, actions can only be assessed at the time of the initiation of administrative proceedings. The duration of the anti-competitive conduct was thus shortened by two months, and a new amount of the fine had to be determined as well. The chairman of the ÚOHS rejected the objections of the party to the proceedings and confirmed the decision on the substantive side. (ČTK)
