ÖBB-Personenverkehr AG withdraws the application for an examination of the economic balance
Vienna/Innsbruck (OTS) – ÖBB-Personenverkehr AG has withdrawn its application for an examination of the economic balance of its transport.
This ends the procedure before the Rail Control Commission and, from a regulatory point of view, the new transports of WESTbahn Management GmbH from Vienna to Innsbruck can be carried out with a timetable change in December 2022.
WESTbahn Management GmbH had notified the Rail Control Commission of its intention to run trains between Vienna and Innsbruck from the 2023 timetable period. ÖBB-Personenverkehr AG then applied to the Rail Control Commission to examine whether these new trains would jeopardize the economic balance of their traffic.
The regulatory authority must be notified of any intention to operate a new commercial rail passenger transport service.
The basis for this is Section 65 (5) EisbG, which implements Article 38 (4) of Directive 2012/34/EU. In particular, rail transport companies that operate public transport on the route (here ÖBB-Personenverkehr AG) can apply for an examination of the economic balance in this case.
As a result, the rail control commission, as the regulatory authority, examines whether significant negative effects of the new traffic on existing traffic are to be expected within the framework of a public service contract.
