ZurichShe wanted a child and threatened to separate – her husband went to court
One man felt his wife’s demand – either child or continued separate homes – as coercion. If it isn’t, two Zurich courts have ruled equally.
-
A couple lives in separate apartments.
-
She doesn’t want to live with her husband again until he gives birth to a child.
-
The man saw it as coercion and went to court.
-
This ruled that this type of claim is not illegal.
A married couple has been alive for almost a year separated from each other, when the woman gave her husband a choice: either he would make her a child or she would no longer want to live with him. The man felt this was unlawful and reported coercion in March 2020, reports the “View”.
Putting pressure on is not yet a punishable offence
More than a year later, in May 2021, the responsible public prosecutor’s office dropped the case. Reason: There is no criminal act. The man did not let that sit and moved on to the Zurich High Court. But this also came to the conclusion that it is not forbidden to give your partner a choice – either children or separation.
condition of the person is irrelevant
The Supreme Court went on to say that there is no role-playing involved in determining whether a man or woman is mentally or physically incapable of procreating a species due to the mentally charged situation.
It is not known whether the couple have found a solution together or are still separated. The man’s fee for obtaining justice in court, procedural fees of 800 francs, cost him.
