the administrative court confirms the termination of the Villa Valmer lease
The SAS had filed an urgent appeal before the courts concerning the cancellation of the lease which bound it to the City of Marseille, voted by the latter.
She prevailed. The decision of the City of Marseille to terminate the long-term administrative lease that linked it to SAS Villa Valmer for a period of 60 years, voted by the municipal council on June 29, was confirmed by the administrative court. The latter rejected the request for suspension of the execution of the deliberation of the municipal council, filed by the hotelier.
“many shortcomings”
The City of Marseille said, in a press release published on Wednesday, “satisfied with this order given the faults committed by the Lessee which led to the termination of the lease”. The municipality recalls that “many shortcomings” had been noted on the part of SAS Villa Valmer.
“Indeed, the SAS Villa Valmer proceeded to the demolition of buildings without authorization from the municipality, in total violation of its contractual obligations and in breach of the urban planning authorization issued, which led the City of Marseille to enact an interruptive order for this destructive work, with the exception of measures strictly necessary for the safety of persons and property, in particular with regard to the risks induced by the construction site in terms of safety and damage to property”, writes the municipality.
The contract provided for the company to transform the municipal monument of the same name, located on the Corniche, and part of the nearby public garden, into a luxury hotel. According to our colleagues from Provencethe hotelier Pierre Mozziconacci would like to appeal to the Council of State.
