San Marino. The stabilization agreement for the temporary public administration has been signed
“A signature awaited for years, which puts in place the tools to put an end to the phenomenon of insecurity in the Public Administration and in the Enlarged Public Sector, therefore also AASLP, AASS, University, CONS and Authority for Civil and Maritime Aviation”.
To announce is a press release. “The signing of the stabilization agreement took place last Thursday afternoon, inside the Parva Domus, in the presence of the Secretaries of State for Internal Affairs, Elena Tonnini, at work, Teodoro Lonfernini, at Education, Andrea Belluzzi, and all the trade unions. The government delegation also included the Secretaries of State for Finance, Marco Gatti, and for Health, Roberto Ciavatta.
The text of the agreement clearly reiterates that job insecurity must remain a commitment within physiological limits even in the public sector: “Whenever a stabilization agreement is signed in the past, generic announcements of ‘to put an end to pre’ always follow. Each deal had to be the last. In fact, however, we have never worked to create the conditions that would allow us to achieve this goal – commented the Secretary Tonnini – we have never worked to try to prevent the formation of precarious work. The agreement signed today, on the other hand, provides for an automatic stabilization mechanism, and makes it aware of the players put in place with the latest decrees relating to the PA, which embodies the principle that the Administration must take responsibility for running the competitions, through careful annual planning. A significant job for the Administration that should not be taken for granted. “
The agreement, therefore, takes note of the path taken by the government with the trade unions, for a more flexible management of public personnel, initiated both with the Requirement (delegated decree No. 162/2021), and with the decree concerning the mobility of personnel public (n 86/2022) recently approved by the Great and General Council. The result of these is precisely the implementation of the automatic stabilization mechanism inserted in decree 86/2021 with the aim of overcoming precariousness in a lasting way.
Public competitions are confirmed as the main tool for accessing open-ended contracts within the PA, naturally based on the needs of the Administration which, when defining its own needs, has a clear idea of how many and which profiles are to be covered in each sector.
Should a precarious position extend beyond three consecutive years, in the absence of competition, a specific administrative responsibility is provided for the public management in charge, in favor of the employee concerned, the permanent employment relationship is transformed. This is the automatic stabilization mechanism.
The agreement is the result of a confrontation that took many months. The reasons for this timing reside in the inclusion of two qualifying and innovative attachments, which will see new government and trade unions engaged at the negotiating table:
Annex 1 provides for the introduction, in the context of the renewal of the public employment contract, of further tools useful for a review of the regulatory and remuneration framework for civil servants. We finally arrive at the so-called “new regime” that has been talked about for over ten years. Also in this case, no one has ever followed up on the generic principle included in the 2011 reform that has reached every stabilization. Today, however, the conditions and criteria for sitting down at the table and giving substance to the “new regime” are established through the attachment. None of the previous governments have reasoned to structure a path in this sense with the trade unions. So this too is a passage in strong discontinuity with the past with which the current government fills with contents what so far have remained only slogans.
Finally, Annex 2 provides for the introduction of competitions as a method for the ordinary recruitment of teachers. The goal is to save the quality standard in the school environment. Here, too, the reforming significance of the intervention, compared to the current situation, is clear.
A realignment with respect to what was already established in 2020 is envisaged for the ISS staff, aimed at consolidating ongoing employment relationships.
In order to calm the economic impact of the stabilization on the state budget, it was decided to postpone the recognition of the effects over several financial years, based on the criterion of greater length of service.
