un médecin mis en cause pour des complications après des circoncisions
A “complex file, both in substance and in form”. In Bordeaux, more than a dozen couples denounce complications after circumcisions performed on their children within the Center de Circumcisions Rituelle (CCR) of the city. More specifically, it is David A., co-founder of the structure and doctor, who is accused of having breach of ethicsrapporteur our colleagues from South West.
The Order of Physicians of New Aquitaine, to which several reports have been reported, believes that these surgeries have proved to be in poor sanitary conditions and with a lack of medical follow-up. Indicted in February 2021 for “involuntary injuries” and “endangering the lives of others”, David A. was recently suspended from duty before calling.
“When you are neither a surgeon, nor an anesthetist, nor a urologist, you do not practice surgery, nor anesthesia, nor urology”, pleads Me Pierre Landete, one of the lawyers for the civil parties, with BFMTV.com .
“considerable pain”
The latter represents three separate couples whose children passed through the hands of David A. for their circumcision. According to the lawyer, the three little boys came out “seriously injured” from these interventions. “According to the experts appointed by the investigating judge, the most injured of them will even have to wait until puberty to benefit from reconstructive surgery. This causes considerable pain,” he explains.
David A., general practitioner from Bordeaux, decides to open the Bordeaux CCR in 2017. He also presents himself as a “mohel”, that is to say the person authorized to perform circumcision on little boys of faith Jewish. However, if these operations are tolerated outside the health system in the name of the free exercise of worship, the doctor is not a surgeon.
“He crosses a threshold that he should not cross,” said Me Pierre Landete. “The number of child victims shows that this doctor does not master the practice.”
On the contrary, for the lawyer for the mis en cause, Me Thibault Soubelet, “these complaints and criticisms alone do not prove that he is responsible” for the complications.
The doctor can continue to practice
Suspended from his duties for two years by the Disciplinary Chamber of the Order of Physicians of New Aquitaine on May 23, David A. and his lawyer appealed against this decision. “The appeal is suspensive, which means that my client can continue to practice as a doctor in the meantime”, details Me Thibault Soubelet, contacted by BFMTV.com on Tuesday.
For each case, the Disciplinary Chamber had decided to suspend the doctor for six months. These different cases, put together, led to a suspension of two years in total.
“It is very questionable because it violates the principle of non-accumulation of sentences”, continues the advice of David A., who is counting on case law so that the National Disciplinary Chamber of the Order, which will have to render its decision on appeal. , to come back to this sanction.
Battle of Experts
“He is a character who multiplies the procedures” to escape sanctions, commented on his side Me Pierre Landete. “Nothing stops him.” Not even the dozen families who have joined as civil parties, denouncing complications following circumcisions performed by the doctor.
Charges that the indicted denies en bloc. “He continues to challenge the grief, both on the information to the parents and on the gesture itself and the follow-up of the children”, lists Me Thibault Soubelet. “An expert in urology has 100% validated the care of Dr. David A.. This is the first time that an expert has been objective in this case”, he continues.
On May 25, it was in another case that the Bordeaux CCR was mentioned: 2-month-old infant died hours after circumcision operated in a house rented by the center in the Bordeaux region. An investigation is underway to determine if a link can be established between the surgery and the death of the child.
