A couple of months ago, this would have been just a statement of fact, but in the current conditions, this is a real victory. The International Luge Federation (FIL) granted the appeal of the Russian Luge Federation (FSSR) and canceled all appointments with Russian athletes, coaches and specialists who were appointed by the recommendations of the Olympic Olympic Committee (IOC). Everyone seized on this case as if it were a saving straw, shouting that the precedent was finally needed. Is there really any hope for the removal of punishment in other sports?

Wrong decision
Deny what happened in luge. Exclusively against the background of the exclusion of such appeals of the Russian Football Union (RFU). Moreover, FIL currently allows not only public lugers, coaches, judges and other participants in international tournaments, but also to hold such a level in Russia. Another question is whether any of the foreigners who are in favor of participating in tournaments in Russia agree.
“The Russian Luge Federation has retained its membership in the international federation. No votes were caught for exclusion, two-thirds were needed for this, and in the end they got less than half. Therefore, we reserve the president of all rights, our athletes take part in international competitions, and Russia hosts competitions,” Natalia Gart said after the meeting of the FIL Congress.

In fact, such a positive decision has become unacceptable to the international community, which, by the way, is not only condemned, but also prohibited in sports achievements. That is why the case with lugers in the Russian Olympic Committee (ROC) is counted on as a precedent, based on which it is possible to apply the topic of discrimination on the basis of a sign in other sports where our athletes were banned.

“The FIL Arbitration Court clearly and unequivocally established that the decision of the Executive Committee of the international federation was dictated by exceptional motives and had no legal grounds for adoption,” Stanislav Pozdnyakov, head of the ROC, added. – An exception authorized that the FIL Executive Committee left for its rightness, filed an application to initiate proceedings against the Russian Luge Federation and Russian athletes who did not come to any disciplinary and public meetings. I believe that the decision of the FIL Court of Arbitration issued on April 7, 2022 will become an important precedent and benchmark when considering appeals against decisions of other international international organizations.”

Sports lawyers also believe in a positive outcome of the case, emphasizing the serious precedent. True, mentioning that other federations do not have to follow it at all.
“Satisfaction of the appeal even before the Russian lugers before the famous competition is a very good precedent for foreign representatives of the federations, which will be taken into account. Of course, it is not mandatory, but it is very important for other federations that such decisions have already been recognized as unlawful,” says lawyer Anna Antseliovich.
Not the last round
An important point was not only the admission of Russian athletes to tournaments, but also the preservation of members of the FSSR in the international sports federation. Especially against the background of the deprivation of the Russian Biathlon Union (RBU) of membership in the International Biathlon Union (IBU). True, the lugers are also not very smooth and there is one “but”. Despite the preservation of the membership of the FSSR, several representatives of Russia were excluded from the FIL executive committee.
“The Russian Luge Federation has been fully restored in its rights. In general, I think we have achieved the result,” said Garth. – But I was expelled from the members of the FIL executive committee, and Albert Demchenko, Alexander Shakhnazarov and Gennady Rodionov – from the working bodies of the international federation. We will definitely file a lawsuit in the FIL Court of Appeal.”

Of course, one can suspect that the appeal will be satisfied here too, and also on the basis of the discrimination clauses, but there is not much hope for this. This is where the stumbling block lies. Yes, a precedent has been created for Russian sports to choose. It’s just unclear whether the FIL will be ready to follow him, not to mention other international federations. It seems that even Pozdnyakov is not completely sure of this.
“Most likely, domestic sports will face something similar more than once in the near future. Nevertheless, even in such a situation, we continue to defend the rights of Russian athletes and our federations.”

It should be understood that the races of sports federations will face serious tension if they launch our athletes in competitions under their auspices. Certainly, representatives of some countries will protest, and large sponsors will surely leave. And the RUSSIAN federation will need to realize remarkable resilience in order to act according to the letter suggests prohibiting discrimination.
