Berlin (dpa / bb) – The trial against a Berlin forester will take place today (9.15 a.m.) in front of the Tiergarten district court. The indictment accuses the 42-year-old of negligent homicide. In February 2019, the man is said to have not carried out the check on Königsallee in Grunewald with the conscientious care and thus misjudged the risk of the tree falling over. On October 28, 2019, the approximately 100-year-old Norway maple fell on the car of a 40-year-old and her husband. The woman died later that night from severe head injuries. The 48-year-old widower is involved in the process as a joint plaintiff.
In order to get an impression of the situation, the district court scheduled an on-site visit at the start of the trial on February 8 and negotiated in the open air at the scene of the accident. According to the expert, the tree had been infested with honey fungus for years and it was a pity. There was initially no conclusive answer as to whether this would have the forester to control & act. Two experts came to different conclusions.
The investigations against the forester were originally discontinued by the public prosecutor’s office. The victim’s relatives filed a complaint with the Attorney General’s Office. Therefore, the district court is now examining the case.
