Entry and residence of Ukrainian nationals in Austria

The Federal Ministry of the Interior provides information about the entry and stay of Ukrainian nationals in Austria, the extension of the stay for humanitarian reasons and the circumstances at the end of the stay.
In principle, Ukrainian nationals can enter Austria without a visa and stay for a period of 90 days in 180 days for tourist purposes. A visa is required for purposes other than tourism, especially for seasonal workers or harvest workers.
Since the Austrian embassy in Kiev is currently not open, (first) visas can be applied for and issued at the Austrian embassies in Pressburg, Slovakia and Ljubljana, Slovenia, as well as at the Austrian Consulate General in Munich. As before, applications for extensions for this group of people can be submitted to the responsible state police headquarters.
Extension of stay for humanitarian reasons
Ukrainian nationals who are already legally staying in Austria and whose legal stay is about to end can contact the local state police department with regard to a stay for humanitarian reasons.
Ukrainian nationals whose permitted length of stay without a visa or length of stay permitted by means of a visa has already expired are no longer legally resident in the federal territory and would be obliged to leave the federal territory. Since the current war situation in Ukraine means that there are no or only very limited return travel options, it may be impossible for you to fulfill your obligation to leave the country. However, since these persons are not at fault for the illegal stay that has occurred with reference to the above description, the current illegal stay cannot be blamed for the duration of this situation.
No consequences under foreign law at the end of the stay
In view of this circumstance, after examining the facts of the case, we refrain from initiating criminal proceedings in individual cases and those affected do not have to fear any restrictions or consequences under alien law. The responsible state police departments have already been informed and instructed. After the situation has normalized and the possibility of leaving the country has been restored, in particular the resumption of air traffic, this must be done independently and as soon as possible.
