Toulouse. Do I have to present a vaccination pass to participate in a public meeting?

The opposition questions the mayor
A few months since the health pass, then the vaccination pass were also requested from people wishing to attend public meetings organized by the City of Toulouse, within the framework of local democracy.
In front of this situation, Anthony Mauricemunicipal councilor of the opposition, a writing, on February 17, 2022, a letter to the mayor of Toulouse, Jean-Luc Moudencin which he questioned the aedile:
“The elected representatives of my group have observed for several weeks now that the pass
health, then the vaccination pass, was requested from residents at the entrance to all citizen participation events in the city of Toulouse. We simply wonder about the legality of this practice and ask you to send us urgently a legal justification for it. Such a practice seems abusive to us and outside the framework of the law”.
Presentation is not necessary
Contacted by Toulouse News, the prefecture of Haute Garonne Answer the question :
“Article 47-1 of the amended decree of June 1, 2021 specifies in 1° of II the list of establishments for which the vaccination pass is compulsory “for the cultural, sporting, recreational or festive activities they host”. Furthermore, the case law of the Constitutional Council specifies that religious, political and union activities are not leisure, cultural, festive or sporting activities within the meaning of article 47-1 of the decree of 1uh June 2021. They are therefore not subject to the vaccination pass”.
She is finishing :
” Thereby, the presentation of a vaccination pass is not necessary to participate in public meetings related to local democracy, for municipal councils, for general meetings of associations, for work or town planning meetings (unless catering activities are organized at the same time)”.
Political meetings, as well as places of worship, are no longer subject to the vaccination pass.
The town hall got it wrong
Contacted by Toulouse Newsthe town hall of Toulouse admits having made a mistake:
“After verification, the presentation of the vaccination pass is not necessary to attend a public meeting of an institutional nature organized by our communities. Our local authorities have taken note of the evolution of the doctrine on this point which had not resulted in any reaction until then. »
