Salzburg: employees terminated because the notice of separation did not come
Not a nationwide problem yet
This is not yet a problem that affects several federal states. According to the Lower Austrian Chamber of Labor (AK NÖ), there are few cases here that are related to a late separation notice. A recent case, however, where a person would have to “give up” their vacation for the time of their isolation. “We will intervene for those affected,” says the AK NÖ.
“If the health authority informs me about the quarantine because I have a positive PCR test, then that has to be taken into account, there can also be verbal notifications. Holidays must be agreed and serve to relax, which is not the case with isolation,” says Doris Rauscher-Kalod, Head of the Department of Labor and Social Law at AK NÖ.
“In these cases, we will support the employees in asserting their claims. Of course, correct and timely information from the authorities is required, which starts with the test results and ends with the notifications. Because employers and employees need the formal processing quickly in order to avoid conflicts and legal uncertainty.”
