The Court of Appeal made public, Monday, January 17, 2022, the results of its activity for 2021: more new cases, longer civil deadlines and a lower operating budget.
The Court of Appeal re-examines, in the event of an appeal, the cases judged at first instance by the judicial courts (TJ), the local courts (TP), the commercial courts and the industrial tribunals (CPH). She makes judgments.
The Toulouse Court of Appeal is headed by two high magistrates, the first president and the general prosecutor.
They are the ones who, during a press conference organized on Monday January 17, 2022, made public the results of the court’s activity for the year 2021.
In terms of handling civil cases, activity saw an increase in new cases, 7,193 compared to 6,057 in 2020. More cases also completed: 7,526 in 2021 compared to 6,143 in 2020. Finally, a slight decrease in cases in progress: 7,410 in 2021 compared to 7,743 the previous year.
The average processing time for civil cases is 14 months for the Toulouse Court of Appeal. This is more than in 2020 (12.5 months) but it remains below the national average level (15.8 months).
In 2021, the Correctional Appeals Chamber saw a slight drop in cases in progress: 1,497 against 1,504 in 2020. On the other hand, more decisions were rendered (1,326 in 2021, against 1,067 in 2020). And there was a significant increase in new cases: 1,261 compared to 1,067 in 2020.
Same trend in the Penal Enforcement Chamber: fewer ongoing cases in 2021 but more new cases (755 compared to 630 in 2020) and more completed cases (814 in 2021 compared to 672 the previous year).
On the other hand, a sharp drop in decisions rendered by the investigating chamber: 1,061 against 1,329 in 2020, and new cases (933 in 2021 against 1,245 in 2020).
The Assize Court delivered 51 judgments at first instance (26 in 2020) and 3 judgments on appeal (3 also in 2020).
The Toulouse Court of Appeal currently has 49 magistrates: 40 at Headquarters and 9 at the Public Prosecutor’s Office. He is one more magistrate than in 2020.
The number of court officials is globally stable but is 70 “theoretical” and 62 “real”. They were 71 in 2019, including 63 “real”.
The evolution of the operating budget of the Toulouse Court of Appeal is as follows: in 2019, the commitment authorizations, that is to say the upper limit of expenditure, which can be committed, were 9,929,399 euros.
In 2021, they are 7,178,974 euros. Or more than three million less.
At the same time, appropriations go from payment, i.e. the upper limit of expenditure that can be ordered or paid, from 8,715,108 euros in 2019 to 9,052,252 euros in 2021.
