CBD: Dijon 16th in the ranking of the establishment of shops in France
Prohibition of the sale of flowers, what is the impact on this trade?
Following the publication of the decree published on Friday December 31, 2021 in the Official Journal, the flowers and raw leaves of CBD, or cannabidiol, are now prohibited for sale in France. Only the authorization to manufacturers has been validated as to the possibility of harvesting, importing or using raw hemp flowers and leaves for the production of extracts.
This decree revised a text of 1990 and follows a judgment of the Court of Justice of the European Union of November 2020.
The latter then rejected the ban on this “well-being hemp” in France, believing that cannabidiol is neither a narcotic, nor a, and was therefore a commodity to circulate freely and whose sale could not be prohibited. if it is also produced in a member state of the European Union.
Faced with this threat of seeing several thousand jobs disappear, the distributors of CBD in France are stepping up to express a political decision going on the scale of the European vision.
On the arrival of the next Council of State on Friday January 07, 2022, the agency specialized in data FLASHS carried out for one of the leaders of the CBD in France, High Society, the first classification of the establishment of the points of sale physics of CBD flowers in the 20 largest French cities (intramural).
With CBD flowers representing on average more than 60% of the sales of these establishments, this ranking also makes it possible to determine the cities that will have the most impact by maintaining this ban.
Dijon is ranked 16th in the ranking of the 20 largest French CBD cities with 0.038 CBD businesses per 1000 inhabitants.
Mao Aoust, President of Haute Société:
“This is a decision that we have already been waiting for several months: this decree was first submitted for observation to the European Commission, with a response time of 3 months. More precise. The decree therefore had to be reviewed in a inter-ministerial process.
Consequences of this decision: legally speaking, the situation has not really changed. The flower was already forbidden. But this decree will now encourage the police to act and apply this repressive policy in our stores.
From an economic point of view, it would be a blow to many activities: distribution, sales, investors, entrepreneurs, producers … “.
High Society is working alongside the UPCBD (the Union of CBD Professionals) to denounce this abusive and unjustified policy. Remedies are provided through:
From a summary of freedom to campaign in favor of entrepreneurial freedom. The decision should be rendered this Wednesday 5/01/2022 by a judge at the administrative court.
An action for annulment because the decree has no legal basis and is damming businesses … this action for annulment was presented to the Court of Justice of the European Union (CJEU) Finally an action for suspension: before all data which were provided to the institutions concerned, we must wait for the suspension of the new decree that they be studied “.
