Salzburg police officer wanted to save son from charges
A senior police officer was accused of attempted abuse of office during a trial in Salzburg on Wednesday. According to the indictment, he wanted to prevent two colleagues in Hallein from reporting his son to the administrative authorities in June 2021 because his moped reached 77 km / h on the roll test stand instead of the maximum design speed of 45 km / h. The process ends with a diverse settlement in the form of a fine of 4,500 euros.
Police control on Pernerinsel
If the defendant pays the fine within 14 days, the criminal proceedings are discontinued. The defense attorney had suggested the diversion, the public prosecutor agreed. At the beginning of the trial, the previously innocent Salzburg man protested his innocence. He did not want to induce the two policemen, who on the evening of June 16, a total of three young moped drivers stopped at Pernerinsel for a priority check, to abuse their office.
Policeman confesses
The two police officers were questioned as witnesses today. They confirmed the prosecution’s allegation. After the chairman of the lay judge’s senate at the Salzburg regional court gave the accused to understand that he was not allowed to intervene in his discretion and in his professional position. He confessed.
Father eats himself to be recognized as a supervisor
The defendant’s son was unable to show either a registration certificate or an original driver’s license during the priority check, but only photos of it on the cell phone. The boy called his father and asked him to bring the documents. A few minutes later, the father appears at the control point. According to the indictment, he identified himself with his ID card, identified himself as the head of a police station and stated that a mandate would be sufficient. The police officers should refrain from checking the design speed of the moped and from filing an administrative criminal complaint.
The accused is also said to have expressed his anger with the words “What kind of company have we become if the gendarmerie didn’t have that”. “He said, ‘Just tear him down an organ and then it’ll fit,'” said the two witnesses. At that time, however, they continued the official act.
Son’s moped way too fast
When the result of the speed check was established, the defendant stated that he had checked his son’s moped once himself, when it was 68 km / h. “He was very upset,” said one of the two police officers. He had not enjoyed the license plate removal. The defendant said: “I knew that it was faster than 45 km / h, but not so fast that the license plate was removed.”
Abuse of office “is far from me”
The accused admitted that he had asked dying colleagues at the time whether it was necessary “for the moped to be put on the roll test stand”. When a police officer asked whether he wanted to induce him to abuse his office, he replied: “That is far from me, exercise your office”. When the old moped was then turned on the roller very loudly and at full throttle, “the emotions probably got away with me,” said the defendant. He was also worried that the moped could break. “The mood was no longer the best,” he said.
