In San Marino from 5 in the morning of Thursday 23 December a new decree-law is in force, the 208 of 2021, which is valid until 5 am on January 31st. The duration of the state of sanitary emergency on the other hand, it is extended until 30 April 2022.

Among the new features, access to supermarkets, grocery discount stores and grocery stores only in individual form, except in cases of necessity for welfare reasons.

a) on public transport (with the exception of students under the age of 12 if the capacity of the means of transport is not equal to 100%);
B) in closed places, including public and private workplaces, where it is not possible to guarantee seats for all those present and whenever it is not possible to keep an interpersonal distance of at least 1.5 meters (such as arcades and bowling);

As of December 23, 2021, it is mandatory for all supermarket operators and the activities of the sale of foodstuffs, including for animals, of the activities of the administration of food and beverages, the use of masks FPP2 while the patrons are excluded.

The employer or the person in charge of the controls are authorized, if they deem it useful in relation to contingent situations (for example following infections within the structure), to their employees, or to the persons summoned, in addition to the San Marino Digital Covid certified, also an negative buffer which one to requisition to enter the workplace. The obligation to provide in any case a adequate distancing between the employees remaining in the company and continuous use of the mask in case it is not possible to maintain a continuous interpersonal distance of at least 1.5 meters.

The activities of “dance club, dance sale, night clubs and the like “. Dance which is also prohibited in bars, restaurants, hotels and accommodation facilities in general. In all cases where it is possible, it is mandatory to carry out the meetings, the conference, I congress, meetings, conferences and similar, with connection methods remotely. If this is not possible, because voting methods are required in person, etc., they are allowed by quantifying the user to the extent of 50% of the capacity maximum expected. The use of masks is required for participants.

L’entry into the Republic of San Marino, for those who come from countries other than Italy and the Vatican City, or who have stayed outside these two countries in the previous 14 days, it is allowed upon presentation:
a) a specific certificate of successful anti-SARS-CoV-2 vaccination or possession of a SARS-CoV-2 check carried out after 1 April 2021 relating to a healing that took place within the previous six months, or a certificate of healing from SARS -CoV-2 occurred within the previous 6 months. This certificate can be either in paper form or in electronic format;
B) with a special certificate attesting negativity to the coronavirus, by subjecting it to a molecular or antigenic swab no later than 48 hours before entry and in any case in compliance with the health protocols in force in the Republic of San Marino. Any molecular swab carried out in the 48 hours prior to entry into the territory of the Italian Republic is valid for those who do not fall within the case referred to in letter a) above.
Children of under the age of ten are exempt from the presentation of the certificates referred to in letters a) and b). San Marino citizens, residents and residing in San Marino territory over ten years of age who re-enter in the Republic of San Marino from countries other than Italy and Vatican City, or who have obtained outside of these two countries in the previous 14 days, if they are not in possession of the certificates referred to in paragraph 1 letter a) and b), have the obligation to contact the ISS Analysis Laboratory before their return, in order to undergo molecular or antigenic buffer within 48 hours of returning with expenses for the execution of clinical investigations to be borne by the same. Alternatively, those over ten years of age are allowed to submit to the ISS Analysis Laboratory a specific certificate attesting to the anti-SARS-CoV-2 vaccination or the negativity to the coronavirus, ascertained by molecular or antigenic swab. carried out in the 48 hours prior to entry into the national territory and in any case compliant with the health protocols in force in the Republic of San Marino. Pending the outcome of the tests, returning guests are required to stay in fiduciary self-isolation. In the event that the investigations are successful, the returning subjects are sent for home isolation. In case of a negative result, there are no restrictions.

Failure to comply with the provisions of this decree – law by the user and by an economic operator with an activity open to the public is punished with an administrative pecuniary sanction equal to 300 euros with the faculty of voluntary donation. In case of reiteration, within 30 days, of the infringements inherent to the economic operators, in addition to the sanctions, temporary suspension and immediate of the operating license for 15 days. The faculty of voluntary donation is excluded. In addition to the penal sanction possibly provided for by the criminal code, the administrative pecuniary sanction of 2,000 euros in case of: a) falsification of health records or production of false health records; B) the conscious display of health documentation belonging to a different person from what exhibits it.
