Zábranský (Pirates): Prague will better protect its employees reporting illegal actions
Following the Directive of the European Parliament and of the Council (EU), which concerns the protection of whistleblowers, the capital city plans to take several concrete measures.
This will allow current and former whistleblowers to file and respond securely. An order issued by the Director of the City Hall as of 17 December 2021 m of Prague will ensure the fulfillment of these obligations.

In the Czech Republic, some provisions of the Directive of the European Parliament and of the Council (EU) adopted on 23 October 2019, which concerns the protection of personal whistleblowers of Union law, will come into force on 17 December 2021.
The directive regulates the procedure for ie. whistleleb, where the whistleblower reports that the offense has the characteristics of a criminal offense, as well as violations of regulations in areas defined by law, such as environmental protection, financial matters or health protection, which he learned in connection with work or similar activities. Whistleblower can therefore protect the public interest by announcing it.
“Although we would deal with more consistent protection of whistleblowers in connection with the planned implementation of the anti-corruption system according to ISO 37001, I am glad that, thanks to the activities of the European Union, the Office is already dealing with this. It is unfortunate that the government of Andrej Babiš has not implemented the Whistleblowing Directive by the deadline set by the end of this year, so unfortunately we do not yet have a comprehensive legal regulation on this issue. The capital city of Prague is also one of the entities that are now obliged to comply with this directive. That is why it is now preparing to ensure its implementation. The main obligations arising from the directive include the introduction of the so-called internal or internal notification system (VOS), which will include setting up the processes for processing, processing and storing individual notifications. The main purpose of creating this system is to obtain sets of procedures and rules that allow whistleblowers to make a safe notification and get a response to it.
City Hall m of Prague in order to meet the obligations of the capital city of Prague arising from the directive, plans several specific steps. First of all, it will be the introduction of the VOS itself, where the emphasis will be on the protection of the notifier’s data. Furthermore, a secure communication application should be created, through which the capital will receive and further process individual submissions. Other notification channels should be a written submission (electronically, for example in the form of an email, or in paper form), or in person or by telephone.
The appointment of persons from among the employees of the relevant department of the City Hall will also be ensured. m Prague, contacts will be listed on the website www.praha.eu so that potential whistleblowers know who to turn to. In order to raise awareness of the existence of the Directive and the possibility of submitting notifications, it is also planned to organize professional training on this topic for municipal staff.
In the continuation, the issue of an order by the Director of the City Hall will be a crucial step. m of Prague, ie a binding internal internal regulation which, in cooperation with experts, will set up all the required processes for fulfilling the obligations set out in the Directive.
With regard to the absence of comprehensive legal regulation of whistleblowing within the Czech legal system, the Department of Legal Support of the City of Prague will m of Prague Regulation prepared and subsequently issued as of 17 December 2O21. Following the entry into force of the Whistleblower Protection Act within the framework of Czech law, the internal regulation in question will subsequently be updated.
