It was possible: Several AfD MPs who had complained before the election of the chancellor in Karlsruhe because the Berlin 2G rule allegedly made it impossible for them to participate, came to the meeting without any problems. Ten of the eleven unsuccessful applicants in Karlsruhe took part last Wednesday, only one was excused. This emerges from the shorthand report of the Bundestag.
The eleven MPs say they are not vaccinated. They had argued that they live “outside Berlin, a long way from the Bundestag” and that they were dependent on overnight stays in the capital during the weeks of the session. With the 2G rule prevailing there, she would have no way of voting for the Federal Chancellor. The tightening of the regulation is a disproportionate interference with the mandate of members of the Bundestag, which is protected by fundamental rights.
The court rejected the constitutional complaint against the 2G regulation. Because the plaintiffs had a violation of fundamental rights “not in time”. In addition, she could first have to turn to the Berlin administrative courts with her urgent application. (Az. 2 BvR 2164/21)

The AfD MP Gereon Bollmann urgently used sharp court scolding. In a message on his website, he spoke of a “new scandal at the Federal Constitutional Court”. This turns a blind eye to the fact that freely elected representatives of the people cannot fulfill their mandate, which is protected by constitutional rights. “Worse still: the non-acceptance of our motion legitimizes an election for chancellor this week, although the Berlin back door will exclude members of the Bundestag from participating. Sleights of this kind are otherwise only known from totalitarian regimes. ”
Bollmann was not excluded at all – and with one exception not the other plaintiffs named by him: Carolin Bachmann, Christina Baum, Marc Bernhard, René Bochmann, Thomas Dietz, Johannes Huber, Jörn König, Jürgen Pohl, Stephan Protschka, Harald Weyel. According to the shorthand report, of the eleven members of parliament, only Pohl was absent from the election of the chancellor. Everyone else turned in their voting cards.
