Acquittal after 20 years in prison: Tempel could have committed the murder, but there is not enough evidence | iROZHLAS
Thirteen years ago, a court sentenced him to two years in prison for murder. He had been behind bars for the twentieth year when a liberating verdict had come to him. The European Court of Human Rights pushed him to Czech courts. “The defendant could have committed the act, but at the same time it was not possible to do so unequivocally and without reasonable doubts,” says the judgment of the High Court in Prague, which has the iROZHLAS.cz server at its disposal.

It was the evening of August 20, 2001, when Robert Tempel, according to the indictment, lured two men to a forest parking lot near Hrušková in the Sokolovská region. At the agreed location, he was to hand over 400,000 crowns to one of them for an Audi vehicle.
But the whole incident – at least according to the indictment – suddenly got a completely different fall: the seller of several shots from a weapon, which criminalists never managed to find, murdered. He shot the other man’s life with more shots and brutal physical violence. Then, according to investigators, both stole mobile phones and buried their bodies in the Cheb region.

In return, the court sent him behind bars for the rest of his life. More than twenty years have passed since the murder, and Robert Tempel is at large again. Following the intervention of the European Court of Human Rights in Strasbourg, the High Court in Prague ruled in October.
Why did the Prague judges finally come to such a conclusion? The iROZHLAS.cz server, with the help of the information law, obtained a verdict that acquitted Tempel.
Judicial ping-pong
The Czech judiciary did not know how to deal with the case from the beginning. While the Regional Court in Pilsen repeatedly issued judgments for failure to prove guilt and thus acquitted Tempel of the charges, the High Court of Appeal in Prague annulled the verdicts and ordered the acquisition of more and more evidence. This has happened exactly four times in about three years.

“The regional court did not become convinced that the guilt of the miner was proved with a degree of certainty, when the unreliability of the testimony remained unaffected after the completion of the evidence,” the Pilsen court stated in 2007. He thus came across the controversial testimony of Crown Witness Lubomír Václav, called Biftek.
It was Václav who was supposed to be at the scene with the Tempel, but before the courts they blamed each other for killing two men. The interrogation of Crown Witness Václav was planned for this year as well, but the judges found out that he died in 2014.
However, the decision from the Pilsen Region in 2007 was returned by the public prosecutor and she appealed again to the High Court in Prague. He not only overturned the entire verdict, but also ordered that the Regional Court in Prague make a new decision on the case.
He thus reacted to the suspicion that the Pilsen court was not able to decide on this matter independently, even though it had previously ruled in a different composition of the senate.
“The Regional Court in Pilsen is not able to get rid of the biased assessment of the evidence, which in turn means that it is not able or lacks the will to decide objectively and fairly,” he criticized.
In Prague, they then decided according to the High Court’s ideas and sent Tempel to prison for life. The exact timeline of how the courts ruled can be found at the end of this article.
Intervention of the European Court of Justice
Tempel did not find support at the European Court of Human Rights in Strasbourg, which made it clear last June that the Czech judiciary had annulled the Convention for the Protection of Human Rights and Fundamental Freedoms. He also accused the High Court in Prague of annulling the verdicts until another court found the perpetrator guilty or assessed the credibility of the witness, even if he did not hear him himself.

Na základě tohoto rozhodnutí následně zrušil Ústavní soud čtyři rozsudky a Vrchní soud v Praze se v letošním roce musel opět zabývat 14 let starým odvoláním státní zástupkyně.
„Odvolací soud své rozhodnutí dílem odůvodnil nedostatečně, dílem postupoval v hrubém rozporu se základními zásadami trestního procesu a dílem jde o rozhodnutí, skrze nějž prosazuje své hodnocení takto provedených důkazů a z něho plynoucí závěry ohledně skutkových zjištění,“ kritizovali ústavní soudci například rozhodnutí vrchního soudu, podle kterého měl případ nově projednat Krajský soud v Praze.
Pražští vrchní soudci navíc měli opomenout většinu klíčových závěrů o svědkově věrohodnosti odkazující na rozpory v jeho výpovědích.
Nejnovější rozsudek
Vrchní soud v Praze – tentokrát v novém složení – se tedy musel znovu vypořádat s odvoláním státní zástupkyně proti osvobozujícímu verdiktu z roku 2007. Tvrdila, že některé části výpovědí svědka Václava potvrdily další důkazy a soud s nimi měl více pracovat.
„Považuji za naprosto nepřijatelné vykládat možný skutkový děj na základě spekulací typu ‚dle mého názoru‘, neboť v trestním řízení jsou jakékoli spekulace nebo domněnky nepřijatelné.“

„Za této situace by bylo podle odvolatelky namístě položit si otázku, kdo z oněch dvou mužů přítomných na místě činu byl ten dominantní, rozhodující, agresivnější, ten, který vraždil. Odkazuje v tomto ohledu na znalecké posudky o vyšetření jejich duševního stavu a na výpověď obžalovaného, který sám sebe označil ve vztahu ke svědku za nadřazeného,“ parafrázoval rozsudek státní zástupkyni.
Tempelův obhájce Jaroslav Ortman na výzvu soudců ale upozornil, že obžaloba nemá žádné přímé důkazy, že vraždil právě jeho klient. „Považuji za naprosto nepřijatelné vykládat možný skutkový děj na základě spekulací typu ‚dle mého názoru‘, neboť v trestním řízení jsou jakékoli spekulace nebo domněnky nepřijatelné,“ doplnil obhajobu.
Nevěrohodní svědci
Vrchnímu soudu v Praze tak nezbylo než se řídit rozsudkem ze Štrasburku, uznal přitom mimořádnou složitost důkazů. „Dominovaly dva stěžejní důkazy – výpověď obžalovaného Tempela a výpovědi svědka Václava. Krajský soud v Plzni v odůvodnění napadeného rozsudku provedl podrobnou rekapitulaci výpovědí obžalovaného i svědka, obsahujících tvrzení, která si odporovala a některá z nich byla i zjevně nevěrohodná,“ připustil senát.
Někteří další svědci navíc tvrdili, že se také nacházeli přímo na místě činu. To soud již dříve vyhodnotil jako zcela jasně nevěrohodné. Nechal proto obstarat i další důkazy – výpovědi znalců z odvětví soudního lékařství, expretízy zaměřené na dokumentaci pohybu hlavních aktérů prostřednictvím monitorování jejich mobilních telefonů nebo biomechanickou analýzu.
Nedostatečné důkazy
„Ani zjištění o pohybu obou hlavních aktérů v době před činem a po něm prostřednictvím monitoringu jejich mobilních telefonů a telefonu poškozeného, stejně jako psychologické profily obžalovaného a svědka vypracované znalci, nevedly k nějakým jednoznačným závěrům,“ stojí v rozsudku Vrchního soudu v Praze.
Právě tato poslední instance připouští možnou Tempelovu vinu, ale není si jí naprosto jistá. „Odvolací senát se proto ocitl v situaci, kdy shromážděné důkazy sice nasvědčovaly reálné možnosti, že obžalovaný se mohl skutku uvedeného v žalobním návrhu dopustit, současně však takový závěr nebylo možno dovodit jednoznačně a bez důvodných pochybností,“ uvedl předseda senátu Robert Fremr.
Protože tedy žádné další důkazy nebyly k dispozici, nezbylo Vrchnímu soudu v Praze nic jiného, než aby nakonec zprošťující rozsudek z roku 2007 potvrdil.
