A nurse struck off by the Toulouse University Hospital while on sick leave: “I did not desert”

A support petition that collected 45,000 signatures, a union outcry and a court decision which must fall this Friday, December 3, 2021. The case of Elodie, nurse since 2007 in Toulouse Children’s Hospital, generate, in recent days, a surge of support.
The heaviest decision for a civil servant
The young woman, mother of three children aged 11, 8 and 2, was removed from civil servant status in mid-November. The most serious decision for a public servant. She no longer receives any salary and her situation is tipping her into financial as well as psychological precariousness …
Is this situation justified? Was the Toulouse University Hospital within its rights? This is what the Toulouse administrative court, seized urgently, will decide on Friday.
The hearing was held this Thursday at the end of the morning. This case will be urgently assessed given Elodie’s situation.
Cancel the deregistration
The young woman’s lawyer asks cancellation of the cancellation.
Small step back. The nurse was put on sick leave at the end of August for mental exhaustion. She had already been arrested several times before, but she found herself in burnout at that time. At the end of August, she meets a licensed doctor who stops her for a month. It sets a return date for 1uh October, without notifying Elodie orally.
The nurse, whose condition did not improve, was then medically checked on September 10, then had her stay extended by her attending physician.
Except that on October 14, she receives a Toulouse University Hospital formal notice stipulating that she must return to her post within 48 hours under penalty of being struck off.
“I did not desert my job”
Elodie says:
“When I received the mail, I read the document diagonally. I was not expecting that at all. This is the first time that a nurse has been struck off in this way. At first, the unions thought it was a joke… It was a discovery for everyone. I entered the CHSCT then a lawyer and I decided to go to the end. I am not in a condition to return to work and I have not abandoned my job. Obviously, the doctor I met on the 10th checked a case indicating that the end of my stoppage was on the 1st.uh October and this cross found me in default of what he told me orally.
An “unfair interpretation”
For the CGT which supports Elodie, “all these sick leaves have all been decided or even justified by approved doctors. She is up to date with her vaccination schedule. The Management of the Toulouse University Hospital uses a small box ticked by a doctor to declare that it is in “abandonment of post”. This is an unfair interpretation of the situation. It is absolutely scandalous, the abandonment of post is very framed in the public service and normally requires checking with several committees that the agent is not in a position of illness to pronounce a decision of such seriousness ” .
Contacted, the CHU announced to wait for the court decision before reacting.
