Franz Fayot at the Competitiveness Council in Brussels: “Luxembourg supports the adoption of the Digital Services Act and the Digital Markets Act”
On November 25, European Ministers of the Economy met in Brussels for a “Competitiveness Council” essentially devoted to the adoption of a political agreement on the “Digital Services Act” (DSA) and the “Digital Markets Act” (DMA). These two digital texts aim to further regulate services in the internal market by creating a coherent European legal framework. In particular, these new rules will ensure that the online environment becomes safer for consumers and that digital markets are fair by banning certain unfair practices from very large platforms. The two regulations will now be the subject of negotiations with the European Parliament from the beginning of 2022 with a view to a final agreement.
The Minister underlined Luxembourg’s support for the adoption of these two texts: “The DSA will set a new European standard for more effective regulation of Internet content and greater accountability of platforms in the fight against the amplification of Internet content. harmful content online “. Thus, for example, there will be a means of public control over the algorithms used by pan-European issues and to deepen the functioning of the internal market. Franz Fayot wished to maximize the chances of concluding quickly, while respecting the delicate balance found between Member States in the Council.
Targeting the giants of the net, the DMA aims to ban a series of practices deemed unfair and unfair in digital markets. The text, for example, prohibits large e-commerce platforms from prioritizing their own services or products over competitors. Another provision obliges them to share certain data with their professional users, for more transparency regarding online advertising. In his speech, the Minister declared: “The DMA is an ambitious and innovative text which creates the potential of a real standard which can be transposed at the global level”.
On the sidelines of the Competitiveness Council, Franz Fayot also had an interview with Commissioner Margrethe Vestager during which he congratulated her for the remarkable preparatory work carried out by the European Commission on these two key issues.
