Resignations and concerns at the Avignon labor tribunal
The Avignon Labor Court asks the Ministry of Justice to appointed five new advisers to operate the miscellaneous activities section. This section settles labor disputes in service trades, from nursing home employees to childminders, including employees of clinics or security companies. This section of Avignon deals with nearly 400 cases per year, it is almost half of the industrial tribunal.
Five out of eight counselors from the employing college have resigned in a few weeks. They explain that they must devote themselves to the life of their company after an extended mandate of one year with the Covid crisis. The council can therefore no longer process the files. They are reported. The CGT, Force Ouvrière and the MEDEF ask the Ministry of Justice to appoint new advisers to respect parity between employers and employees. This procedure goes through a platform which will appoint the replacements in January at the earliest.
CGT and FO fear the end of the prudhommes
Stéphanie Gros, CGT vice-president of the industrial tribunal fears the appointment of professional judges: “The additional designations interfere with the operation of the industrial tribunal. I analyze it as a clear desire on the part of the justice ministry to say ‘look: this advice no longer works. We will therefore be forced to relocate, close or set up professional judges’. We no longer have the means today to compensate for all these resignations. We are tending towards the disappearance of joint labor tribunals “.
No danger for the MEDEF president of the industrial tribunal
Sylvie Bres, the president of the MEDEF of the Avignon industrial tribunal, also asks for a rapid replacement of the resigning advisers via the government platform. It ensures that the functioning of the Avignon labor tribunal will be ensured: “There have been a series of resignations due to a combination of circumstances. We can dispatch two councilors from one section to another. Today we are not in danger. We will be able to manage this but I call on the Ministry of Justice to urgently open the platform to find additional advisers “.
