“The report assessed in great detail the aspects of the defendant’s driving, which the court assessed in connection with other evidence, and concluded that it is appropriate to use the legal qualification under paragraph 272 paragraph 2 of the Criminal Code,” said Senate President Jan Petráková. That paragraph concerns serious crime of general threat, punishable by 8 to 15 years in prison.
According to the law, it is committed by a person who “intentionally causes general danger by putting people in danger of death or serious injury (…) or commits any other similar dangerous act and if by such an act he causes serious damage to the health of at least two persons or death ”.
The chairwoman reminded that Jitka R. had 2.13 per mille of alcohol after the accident and, according to expert opinions, in the past had alcohol consumption and driving a motor vehicle. “Her driving style, as documented by expert research, was such that during slower driving, the vehicle was to be controlled during the measurement and reacted to the traffic situation, but when he got to higher speeds with the car, he lost the ability to control the vehicle. “
She also noted that Jitka R. caused the first small carom that day shortly after she got behind the wheel, then hurt the mirror of the parked car. “It is striking that the initial car accident did not stop the defendant. She kept driving and that was basically the reason“why the traumatic situation occurred,” she added. The report also states that it accelerated to speeds in excess of 200 km / h. “The cause of the traffic was the defendant’s driving technique combined with her drunkenness of accidents,” the chairwoman added.
12 vehicles narrowly passed
According to the court, the expert institute also carefully documented the threat to other drivers. Earlier, one of the witnesses in court said that Jitka R. missed her by only inches. “He narrowly missed 12 vehicles. It was clear from the witnesses’ testimony that the defendant’s ride was as risky as possible and he had to dodge, “One of the reasons why the act could be reclassified as a general threat was stated in court. She also added that it was clearly documented that the driver of the police car did not have a chance to react to her driving.

The President of the Senate concluded that Jitka R. was extremely risky, her driving was ruthless with the same speed, she absolutely ignores all the regulations concerning traffic on the roads. “It was obvious she wasn’t even moving at that tremendous speed in her lane and endangered many other drivers. This fact is well documented by witness statements and expert opinion and documentary rides according to camera recordings, “added Petráková.
If the High Court reclassifies the act as a general threat, the case will be dealt with by the Municipal Court in Prague.
