Slovenian authorized prosecutors appointed “temporarily” – EURACTIV.com
The Slovenian government has decided to appoint Tanja Frank Eler and Matej Oštir as state prosecutors delegated to the European Public Prosecutor’s Office (EPPO). However, their appointment is “temporary” and is valid until the completion of the national appointment procedure.
The government found that the current appointment process had not been completed under the Public Prosecutor’s Office Act because too few nominations had been submitted.
However, as Slovenia is late in submitting candidates for delegated prosecutors, the government has decided to deploy the two candidates who have applied until the end of the national appointment procedure.
The move came after Justice Minister Marjan Dikaucic allegedly rejected the applications of Frank Eler and Ostir in a tender published in July, after the government annulled the first tender in May.
Frank Eler and Oštir, who also applied for the first call, asked the administrative court to review the annulment of the appointment procedure.
In October, the court overturned the government’s annulment decision and postponed it back to the government, which then ruled that the court’s judgment could not be enforced because the first proceeding ended with the July announcement of a new tender.
Frank Eler and Oštir were the only candidates to apply for the new tender.
Slovenia is the last country to participate in the EPPO, which appoints its delegated prosecutors. The European Commission and the head of the European Public Prosecutor’s Office have repeatedly called on the government to do so and even threatened sanctions.
