San Marino. Compensation to managers, the Cons sanctions the FSGC
Remuneration to managers, the San Marino National Olympic Committee sanctions the San Marino football federation.
The decision was made last night by National Council of the Cons, the body composed of the presidents of all the federations, and thus closes the procedure pursuant to article 41 of law 149/2015 – or the in-depth activity relating to a single federation – regarding the compensation-reimbursements paid to the members of the federal council of the San Marino football federation from 2017 to 2020.
With open vote unanimously, With the’abstention by the president of the FSGC, Marco Tura, the sanction of the temporary and partial suspension of the affiliation of the San Marino football federation until 31 December 2021.
“The measure – explains the Cons in a note – involves theinhibition of the federal legal representative to take part in all the initiatives and activities of the Olympic Committee, including the representation of the Federation in the bodies of the Cons with the suspension of the right to participate and vote “.
But “does not affect federal activity nor access to sports facilities by members and members of the FSGC for the performance of federal sports activities and its affiliates “.
Five assessments reported in the resolution of the National Council to motivate the decision. First of all it is pointed out that “the FSGC has opposed a uncooperative behavior in the initial phase of the investigations by the Executive Committee and with substantial disavowal of the role of the CONS, both for verifications and general guidelines, as per documentation in the deeds, consequential to art. 29 paragraph 5 “.
Then he remembers that “the FSGC did not comply with the directives of the Executive Committee “ about “the” suspension “of the payment of remuneration to the members of the Federal Council in the absence of a Regulation ratified by the CONS at least until the conclusion of the investigations pursuant to Article 19, paragraph 1, point c)”. Suspension requested by the Cons “as a precautionary measure also to protect the affiliates” but not respected by the FSGC which paid “for the year 2019 and 2020 fees to the members of the Federal Council, thus reiterating the non-collaborative attitude in violation of art. 29, paragraph 5 “.
An attitude, it is underlined in the resolution, is not “adequate towards the CONS”, with “dilating effects in the first phase of the investigations, referring deeds and documents with considerable delay. “The document says that this behavior was later recognized by the president Marco Tura who,” while reiterating that he had always acted in good faith “, made amends at the meeting on 21 October.
Finally, it is acknowledged that “the FSGC has formally regularized the internal sports regulation with regard to the disbursement of reimbursement fees to members of the federal council through the filing of the federal statute and the “Regulations for the regulation of attendance fees and analytical and kilometric reimbursement of expenses to sports managers assigned to the bodies of the FSGC“filed with the CONS on March 3, 2021 and ratified by the National Council on July 8, 2021”.
Last night’s meeting is therefore the epilogue of that, much more animated and full-bodied, of last October 21 in which the National Council first rejected the proposal for the procedure pursuant to article 41 with a solution, but did not find the agreement for a sanction that would not affect in any way the internal activities and operations of the FSGC.
