The chairman of a social association in Salzburg was sentenced to three months probation at the regional court on Tuesday evening – for “grossly negligent for the purpose of creditors’ interests” and for a deed
The so far innocent defendant was acquitted of the allegations of infidelity and the improper use of funds. The judgment is not final.
Judge with severe criticism
As of 2018, the accused is said to have grossly caused the solvency of the social association, which had focused on supporting ethnic minorities. “Your bookkeeping was a mess”, the judge preferred on the first day of the trial in June: “As chairman ‘freestyle’ you passed all commercial and association laws.”
The man admitted “sloppiness” and said he had relied on the bookkeeping.
Defense attorney denies private withdrawals
The defendant stated that he had used club money, for example for private car trips. The public prosecutor’s office had assumed a total of 32,000 euros in damage. The defense attorney Stern denied that his client had used club money for purposes other than intended or for his own purposes. In the case of private withdrawals, it was about money that the defendant had advanced on his own initiative when the association was founded.
The judgment is not final because the financial procurator has not given an explanation. The public prosecutor and the accused waived their right to appeal.
