Cape Verde without children for adoption. There are pending orders from Portugal
sAccording to the annual report on the situation of Justice, referring to the legal year 2020/2021 (August 1st to July 31st), prepared by the Superior Council of the Public Ministry (CSMP), the situation of “children available for adoption has not changed” in the last year and information from national institutions “indicated that there are no children available for international adoption, which has been happening for the last six years”.
This is the reason why “there has been withdrawal of pending applications and there have not been many entries of candidacies for new adoptions. For the same reason, there remains a high number of pending candidacies, 74”, the report reads.
In the last judicial year, Cape Verdean authorities received two new requests for approval, both from Portugal, as in 2019/2020, which ended with 75 cases pending. Three administrative proceedings were also filed with requests for adoption, one for withdrawal, in relation to the request coming from Spain, and two “following full approval due to those coming from France”.
Of the pending cases, 58 are from Portugal, seven from France, seven from Spain, among others.
The report adds that of the total of 74 pending cases, 65 “await the identification of a child for adoption”.
“In the previous judicial year, the CAI [Comissão para Adoção Internacional] maintain regular contacts with the Central Authorities with applications filed in Cape Verde, requesting information on the maintenance of the applicants’ interest, taking into account the long waiting period. From the selected contacts, the response from Portugal, in relation to some processes, for which information is awaited in relation to the other pending processes and from the other authorities”, the report also reads.
This Friday, Cape Verde’s parliament will discuss the state of justice in the country, specifically addressing this MP’s report.
“Most of the pending cases were filed between 2005 and 2009 and with an element to the Attorney General’s Office [PGR] from Central Authority Authority to International Adoption, were transferred to the PGR,” the report secretes.
