More than a year after leaving their historic premises in Allées Jean Jaurès to move to 7 rue Lapeyrouse, the Toulouse Gift House has chosen to inaugurate its new address Friday 15 October 2021.
Were present at this ceremony Jean-Luc Moudenc, the mayor of the city stood up, Francois Toujas, the president of the French Blood Establishment (EFS)… and also members of the Homodonor collective who campaign for the reintegration of homosexual and bisexual blood donors into the blood transfusion circuit. They too were there to slash the champagne but not for the same reasons.
“We were there to celebrate our victory and especially to speak out to express the shameful attempt of the EFS to silence us. ”
The EFS rejected all of its requests
To understand this frontal load of Frédéric Pécharman, we must go back to the thread of events. Earlier this week, the EFS took legal action against the Toulouse association in summary proceedings.
A procedure that makes it possible to request interim measures in order to settle urgent cases. In this specific case, to prohibit the presence of the collective for fear of seeing the inauguration ceremony disrupted. More broadly accused of interfering with the smooth running of blood donations during militant actions (occupation of premises, wild posting, distribution of leaflets) at the Maison du don in Toulouse, the association risked fines of up to 5,000 euros. .
“He also asked for 1,000 euros per new share as well as the obligation to remove all of our videos and photos posted on our social networks. Clearly it was a bazooka procedure to gag us and stifle us financially. We had less than 24 hours to find a lawyer and prepare our case, but luckily the hand of Justice diverted the weapon from its target. The vice-president of the Toulouse Judicial Court entirely rejected the EFS in its delusional requests. ”
And to continue: “And then frankly, to declare that by part of our actions – which are always non-violent – We are ten grand maximum each time. “
Feeling of incomprehension
Contacted, the French Blood Establishment explained that he did not want to “comment on a court decision and prefers to focus on his collection mission. Our priority is to supply hospitals with blood products to meet the needs of patients. “
Behind this official declaration appears a feeling of incomprehension vis-à-vis the demands of the Homodonneur collective “even though the bioethics law passed in June puts an end to the four-month sexual abstinence required of homosexuals and bisexuals to give sang to them. Adopted definitively, it should enter into force in January 2022. ”
Stigma that endures
If for the EFS there is obviously no more grounds for controversy on this subject, it is not the opinion of Frédéric Pécharman and his colleagues from the association who say they still suffer from stigmatization. They want as proof the videoconference meeting in which they participated with the DGS, the Directorate General of Health.
We are part of the working group on the development of the future questionnaire that will be given to donors before each blood donation. And while the bioethics law must put an end to discrimination, some are dependent on incomes with questions on sexual practices, in particular anal sex or “chemsex”, sex under drugs. These intrusive questions do not need to be because they stigmatize. Only the four-month monogamy should count, period. ”
On this very specific subject of the future questionnaire, which will have to take into account the latest changes concerning the criteria for donors, the EFS recalls that it is in no way a decision maker, “it is the Ministry of Health who has the main “. The French Blood Establishment has 15 days to appeal this court decision.
